Dog Issue
Next door have a dog, looks like a black lab or similar. It is kept outside all of the time, between the side of ours and next doors house. There is a some sort of open kennel at one end and a gate at the other.
Now the pain in the *** for us is the dog howls and both our bedroom and lounge is on that side of the house. Obviously i need to speak to the neighbours however i'm a bit worried about how the dog is being kept.
The side of the house is in shade all the time and at this time of year is obviously VERY cold. They are a youngish couple and work long hours, not back till late at night at times. It may not be fair on the dog, but is it legally wrong?

Depends whats in the said kennel.
Temps fell below zero last night and my dog decided outdoors was the place to be, and stayed out for over an hour til called in.
But then he is a Malamute.
If the kennel has shelter and something to curl up on, he could be ok, but Labs are not the most cold weathered dogs about.
The howling is more likely he is lonely and wants attention.

Unfortunatly at this time of year - I'm sad to say you'll get little or no assistance from the RSPCA. A friend of mine owns a respected kennels and has alot of input with rescue dogs etc - she told me the other day that there are that many homeless dogs and so few people taking them in - the RSPCA are now looking to putting them to sleep 
If I were you - I'd have a word with the neighbour first - tell them your concerns, explain the noise etc.
I have 3 dogs and if i had caused a problem with them - I'd much prefer for my neighbours to come to me as opposed to the RSPCA.

btw - Whoever is giving out those infractions should probably be shot instead of the dog...... Dogs do what you train them to do..... some people are complete dimwitted w4nkers

You think leaving a dog out in the cold is cruel? How did they survive for 60 million years before we got central heating?

If you feed a dog properly it wont get cold. If it howls, it probably means that it gets attention sometimes and none at other times. That probably means the owners get home and spoil it stupid all evening, then stick it outside all day so it doesn't **** on the cooker. Have a quiet word about the howling. If you get the RSPCA involved it will be a war for all time

Come on - that really does not deserve an infraction!
I love dogs, but I hate them with a vengeance when I step in their pooh!
Quite a few of these infractions are out of order and IMHO this is one of them.
But then I suppose someone will now infract me for saying so - they did the last time!

Go to the Council AND the RSPCA. It is a noise abatement issue and an animal welfare one. But note, plenty of dogs are kept outside and, as long as it has some space and the kennel is dry and draught-free with good bedding and fresh water, there's nothing wrong with that.

does the dog look thin and unhealthy??? does it look like it gets beaten? is it overly aggressive??? if not then why call the RSPCA???? talk to your neighbour about your concerns over the dog ie noise wise but i would be careful how you approach the issue as i would go ballistic if anyone tried to insinuate i was mis treating my boys or putting them in unecessary discomfort, when its clear you are talking about something you know minimium facts on. also unless the dog is making noise at anti social hours (11pm to 7am) theres not alot the police etc can do.
the only reason my dogs stay in the house is because i dont have a garden otherwise thats where they'd be when i was at work. the dog has the freedom of the open space to exercise and is not confined to a single room of a house like many other dogs. you'll probably find there is food and water in the shed and some sort of bedding. being a dog owner i also find it hard to believe it whines or barks constantly as it would develop problematic breathing and coughing
