Yellow box penalty problem

Yellow box penalty problem
A friend has received a penalty notice for stopping in a yellow box at a junction. However, the photos sent with the notice show the car had moved - so it wasn't stationary. It might have been moving slowly. How should the case be handled? Thanks

You shouldn't enter the yellow box junction unless your exit is clear.
Obviousley your friend entered the junction when his exit was NOT clear or he wouldn't still be in the yellow boxes therefore he has rightly received the penalty notice.
Guilty as charged!

I'd say it would depend how far apart the photos were, how much the car moved in that time and whether there was space for the car to move forward so that it's not blocking the box. If it's several seconds, and the car has only moved a foot or so and there is space, then to be honest, they are as good as stationary and presumably would be blocking the junction had the lights changed.

Rule 174 in the Highway Code:
174
Box junctions. These have criss-cross yellow lines painted on the road (see 'Road markings'). You MUST NOT enter the box until your exit road or lane is clear. However, you may enter the box and wait when you want to turn right, and are only stopped from doing so by oncoming traffic, or by other vehicles waiting to turn right. At signalled roundabouts you MUST NOT enter the box unless you can cross over it completely without stopping.
I guess the prosecution feel your friend entered the box when they shouldnt have done so, the camera will be linked to the traffic light sequence.
