Default IR 35 Tax, any experts

I have been offered a job with as a broadband installer but I'm not sure if it's worth it.

I earn 30k a year plus health care, sick pay, 5 weeks holiday etc etc. I spent £2300 on train travel.

The new role is self employed plus you pay the company 110 pound a week for the van and phone etc plus your own fuel, they give between 6 and 8 jobs a day starting at 16 pound per job rising to 19 pounds after 9 months.

It's Mon- Sat (6 days a week) I work 5 days at the moment 9:00-5:30.

I have spoke to them this morning and they have said they are not sure about the IR35 tax, can anyone shed any light on this matter. My wife is 6 months pregnant so I don't want to take the job and then fine I'm a lot worse off than I was as we will be losing one wage when she finishes work in December.


Here are the job details:

Please find below an approx breakdown of wages, I have taken an average on fuel and parking for this example. These are all based on a 6 day working week.


First 3 months
Bronze - 16 x 6 jobs x 6 days - 110 = 466 x 12 = 5592
Bronze - total expense (diesel 42 p/w, parking 40 p/w and £110 van = 192) = 384 x 12 = 4608
Bronze - 16 x 7 jobs x 6 days = 672 - (expenses £192) = £480 x 12 = 5760
Bronze - 16 x 8 jobs x 6 days = 768 - (expenses £192) = £576 x 12 = 6912


After 6 months
Silver - 17.5 x 6 x 6 - 110 = 520 x 12 = 6240
Silver - total expense (diesel 42 p/w, parking 40 p/w and £110 van = 192) = 438 x 12 = 5256
Silver - 17.5 x 7 x 6 = 735 - (expenses £192) = 543 x 12 = 6516
Silver - 17.5 x 8 x 6 = 840 - (expenses £192) = 648 x 12 = 7776


After 9 months
Gold - 19 x 6 x 6 - 110 = 574 x 24 = 13776
Gold - total expense (diesel 42 p/w, parking 40 p/w and £110 van = 192) = 492 x 24 = 11808
Gold - 19 x 7 x 6 = 798 - (expenses £192) = 606 x 24 = 14544
Gold - 19 x 8 x 6 = 912 - (expenses £192) = 720 x 24 = 17280

As mentioned at our interview there will also be supervisory positions coming available which are still self employed, but are a flat day rate of £95 over 6 days. With a company vehicle supplied at no extra cost. This works out to £570 per week or approx £27360 over the year (48 weeks).

you'd be mad to do that.

your wife is just about to give birth and you're contemplating moving from a good job where the company knows you and will be lenient if you need time off
to...
an inflexible contract type job where you need to work 6 days a week and pay expenses, for actually less pay than your salaried job - yes work it out!

btw, IR35 is for service companies attempting to hide behind limited company tax laws to avoid the real fact that they are, essentially, an employee of the company who hired their services.

i don't think this applies to 'sole traders'

I see what your saying but I hate my current role since I was moved to another team and I'm ready for off sooner rather than later. Looks like I may have to stick it out a bit longer until a better offer comes along.

do your sums and be pessimistic

i was contract for 10 years and always worked on 45 working weeks a year with days off and sick
