Default Speeding

Ok, this is just a hypothetical question, I have not been caught speeding, before everyone gets PC! (Touches wood! )

What would happen if, for example, your car was recorded doing over 100mph and you get a NIP, no photograph, maybe laser etc. Now we all know that that will mean a ban/lots of points, possible loss of job etc.

I know of the Idris Francis case about non disclosure, but what would happen if you refused to name the driver of the car at the time of offence? I assume you'd get three points for non disclosure. (A driver who caused an accident with me ignored the police demands for a name and they prosecuted for non disclosure. Three points IIRC)

Remember this is a hypothetical question

Depends on what they have done with the law regarding non-disclosure. I am sure someone will know about that.

If the car was doing three figure speeds they would not want to drop the case for sure.

Im guessing that you was pulled over on site? (theoretically ) Otherwise I dont think they can send you an NIP without photographic evidence.

My car was spotted travelling at 107mph. As I was unable to inform them of the DEFINATE driver at the time of the offence they were unable to proceed. However as I had disclosed BOTH names of possible drivers, it was also not possible to proceed with NON disclosure.

Lucky it took so long to open the letter with the NIP in it, or I might have remembered who was driving.

failing to furnish at the moment carries a 3 point penalty and a big fine £300+ (income related). There is a very slim cahnce of a discretionary ban, but this is very rare.

Insurance companies vary with premium loading with a MS90 offence
