What to expect in court - over the limit and speeding?
Last month I was in a crash and went into the back of another car – two passengers had minor injuries and I was arrested. I got breathalysed and was over the limit and got charged for that. They also want to do me for dangerous driving for speeding.
I know what I’ve done was stupid and can see that now but just wondering if anybody knows what I can expect in court?
I had a driving ban in 2005 (drink driving) and have a convinction for drunk and disorderly and criminal damage. I know it sounds bad but I’m really stressed out about it all now.
If anybody has any advice about what I could do to make things better for court that would be great. I know I'll be banned again and fined but hope it isn't anything worse.

Likely to be more than 18 months as they will take into account the dangerous and speeding + the fact that you have been convicted fo DD before. chances are you will get done for all three and them added together
Guessing at 4 yrs ban, likely you will struggle to get insurance in future as well, you now have a hisitory of DD, one off could be bad judgement or a mistake, twice is not!
As you go though life it is best to learn from your mistakes, and move on
If you have a drink problem then deal with it and stop endangering other people.

Sure it would be a 3 year ban. Depending on the outcome of the dangerous driving/speeding and injuries caused, I would say it depends on how fast they estimate you were travelling and the circumstances behind the incident (positioning and if the other party was any part percentage at fault like pulled out on you or something). But I would say at best for you, a 3 year ban, and at worst 12 months in prison and 5 year ban.

However, have a look at This site. The maximum penalty for drink driving is 6 months in jail, £5000 fine and a 3 year ban.
The sentence will depend on the circumstances. eg. was it the "morning after" and were you just over the limit, or were you well over the limit and driving immediately after leaving the pub? Either way, doing it again so soon after you got your licence back doesn't look good and a conviction for drunk and disorderly suggests you may have a problem.
As the others have said, I have no sympathy but hope this answer has at least been helpful. 5ive-o will be able to give you a better guide to your likely punshment if you tell them the full circumstances.

If you are convicted of:
Causing death by careless driving when under the influence of drink or drugs.
The maximum penalty is:
14 years' imprisonment, an unlimited fine, disqualification from driving for at least 2 years and a mandatory extended driving test.
Driving or attempting to drive whilst above the legal limit or unfit through drink.
6 months imprisonment, a fine of up to £5,000 and disqualification from driving for at least 12 months (3 years if convicted twice in 10 years).
Being in charge of a vehicle whilst above the legal limit or unfit through drink.
3 months imprisonment, a fine of £2,500 and discretionary disqualification from driving.
Causing death by careless driving when under the influence of drink or drugs.

As far as I can see it depends on the mood of the magistrate..
It took a few attempts by my nephew (who's not particularly bright) to actually get himself sent down...
He got done for driving without a licence, insurance etc.. got some community service.. (was 17 at the time) + banned for 3 months
About 6 months later...
He got done for the same + DD he got more community service and bound over + banned for 12 months
About 9 months later he got done for the same +DD he got sent down for 12 weeks and served 6 + banned for 2 years
Then about 6 months later he got done for same no DD but + TWOC got sent down for 28 days
I couldn't believe it I was all for locking him up and throwing away the key!

I feel sorry for the innocent parties that got injuries (minor or otherwise)because of your actions.

I think the main thing is not to lose your confidence in drinking and/or driving. So I would just carry on as you are but try not to kill anyone in uniform as that could go against you.
You'll be saving a lot on insurance as you won't be able to get any and therefore have nothing to pay And when you get done again you'll probably qualify for a rehab' programme which might even be overseas. No chance of the slammer as they will all be full of motorists doing time for serious stuff like parking and little old ladies who can't pay their council tax. All the best. I admire your grit and determination.

Well if they had been harder on you for the DD you may not be in this situation now, unlucky but I have no sympathy for you TBH as you should have learnt, if you don't goto jail you are a lucky person, hopefully you will as it may be the only way you will learn. The course of your action will probaly ruin you life, you may lose everything dear to you and more, this in itself is a harsh lesson & something that people should think about before drinking and driving.

I think you guys are well out of order! Someone comes here for advice and should not be judged. If he is going to get banged up he needs to know how long for so he can make arrangements like..
