Unhappy Speed camera

I was going down the A38 towards marsh mills, plymouth which is a dual cariageway with 3 lanes each side, i was in the company van when a B*****D in the safety camera van clocked me at 74 mph. Had i been in a car i would of got away with it being national speed limit and having a 10% leway. This pissed me right off because its excactly the same layout on the road as a motorway, but unknown to me the national speed limit is 60mph if you are in a van which i dont really see why as you can drive a van on a normal driving license. it seems yet again they're being crafty and tricking people out of cash as i'm not sure how many people actually know its different speed limit in a van to a car espeacialy when the road is identical to the motorway.

Had it been a different situation i.e outside a school with children crossing i would of excepted it and paid up instantly. However this is not the case and i fully intend to fight it this time. Check out this advice on ABD - How to defend yourself against speed camera prosecutions and see what you think?

Also if anyone has any info or any copies of these letters to avoid fixed penalties saved to there computer on how to get out of fixed penaltys after you've been snapped i would be very grateful if you could forward me a copy at danbull4@hotmail.com

If the van you were driving is not plated... over 3.5t... then you have the same driving laws to adhere to as a car, so you'd be not guilty.

if the tax on the van is plg the same as a car then the speed laws are the same
unless you had a trailor on the back

You were alleged to be going at 74mph, which is still over the prescribe limit. If your vehicle is classed the same as a car, then write explaining this. Dont write and accept that you were speeding, even by a small amount, but emphasise, that your vehicle is in the same class as a car, and and was alleged to have been caught under the ACPO thresholds, before the police initiate prosecution.

Most people on here don't have a clue, so check the limits for yourself here:

I looked at that link, and it classed vans up to 2 ton laden weight the same as cars, so maybe they could be within they're rights on this as the vans max weight is 3.5 ton, Have to check the tax disc class

Bro in law's a mag, here in North Lincs. Police/CPS here have recently been sending folk to court for well under ACPO guidelines. They are just that, remember, GUIDELINES, not the law. The law says 70mph, that's the limit

Not condoning speed cameras, I hate them with a vengeance. I subscribe to the French view: they call speed cameras, "boites a sous", or translated: "money boxes"

Alcazar

BTW: lots of our MOBILE cameras here are now equipped with extra cameras that get you in both directions, both in front of, and behind, the van

They are also equipping seized cars with cameras and putting them in as covert scammers

The point is, they will say that you should personally make sure that you know the law according to the vehicle you are driving, even though it is a bit rich for being done for 74 MPH.

Maybe the van's weight will get you off with a bit of luck. Did not know they use speedcams along there-will have to look out for that when I drive along there.

speed limit for a transit style van is 70mph in a national speed limit on a road with 2 lanes each way or above, you should get 10% so as long as your under 77 you should get away with it, however the 10% is at the descretion of the courts.

tbh my gut feeling says if your speedo said 74 then you were only doing about 65-70 anyway

Goods vehicles upto 2000kg GVW share speed limits with cars. Over 2000kgs its 50mph on single carriageways, 60mph on dual carriageways and 70mph on motorways.

Over 2000kgs includes all the 4x4 Pickups, all Transits and similar size vans, the Transit Connect, new VW Caddy, Peugeot Experts, Citroen Dispatch, Fiat Scudo, some Vauxhall Combo's and a few more I can name.

Just had a look at the sussex scamera partnership site...

According to them....

Quote

. SSCP officers may wish to work at additional sites, if operational commitment allows, though only those shown on the website map.

Unquote...

and guess what..... the two sites they were at , are not on the map!!!!
