Mobile Phone privacy and abuse issues
We have a problem at work with one of our drivers being constantly on his mobile phone (both personal and company).
He went off sick on Monday and out of sheer curiousity one of the other drivers decided to check the first guys company mobile. Too say he was disgusted is an understatement. On the company mobile there is hard core **** pictures and texts.
We then realised that this guy's personal phone was also at work and switched on. On investigating we have found "normal ****", "gay ****" and images of school children (in uniform).
We will be handing the company mobile to the MD tomorrow.
In the mean time what can we do about the images and what they suggest (paedophilia), that we have found on the guys personal mobile?

He should be suspended on full pay pending a full investigation by the police, your HR department cannot sack him untill they he is convicted of breaking the law using company property.
If there is a company policing on the 'misuse' of comapny phones they can follow their documented disciplinery procedures, but.....
If he is sacked on the basis you've assumed it was him downloading all the **** he can (and will) take you to court for wrong dismissal, and he'll win as well, as the only people that can prove this is the police and in a court of law.
Lets face it others have had access to the phones as well, so you can't be 100% sure who's done what and when!

Dont know about his personal phone as you might not have the right to access this, but Co. phone to the police asap. and immediate suspension while under investigation, if your Co. requires him to interact with the public and you continue to allow this you could be in a sh1tstorm here.
You know it the right thing to do ASAP.

Depending how the stuff got onto the phones I expect it would be pretty difficult to prove that he downloaded them due to other people having had access to the phones. However if he's into that stuff chances are he'll have a lot more of it on his home PC which the Police may look into.

The above should qualify the guy for gross misconduct anyhow.
As for the type of images i would suggest the Police take a look if you are at all concerned.

I was going to say that!!!
I've got pictures of my kids in school uniform on my work PC as well!!!! Is that bad?????
Come to think of it, there are pictures of other kids on there too. I take lots of pictures of lots of things, they all end up on my work PC.

If the children are in a uniform, im sorry but the police wont do anything about, it, not one thing its not agaisnt the law, now if they were in a state of undress etc diffrent matter alltogether.

I'm just trying to think of any valid reason (curiosity is an excuse, not a valid reason) for checking either of the phones. If you had suspicions there should be procedures to follow to investigate those suspicions. But to allow on a whim someone to access the phone, without the individual being present, and then to interrogate the individuals personal property in secret also........
Regardless of what was found the other driver should also be investigated for his behaviour, and the company should take some very competent legal advice on how to proceed, without getting their asses sued off them.

i didn't go through his phone, one of the other driver's did.
the guy with the **** on his phone has been constantly texting and making and receiving calls on at least 3 mobile phones during work time for the last 6 weeks or so. he has done virtually no work and it has caused some major issues in the workshop, with the other drivers having to cover and do extra work. we are currently between depot managers and this person is taking advantage of the situation.
this is why one of them picked up the company mobile in the first place.
the **** in question is fairly disgusting and i certainly couldn't give details on here

I think you should keep what you've done to yourself, then make sure he is escorted and offered a representive as a witness while his phone is checked while he is in view of it.
