Put the toe of the stock on the floor and lean the end of the barrels on a soft chair and, holding the gun upright, put some pressure downwards directly above the hinge pin with one hand (so that you are effectively trying to close the gun even more). Then with the other hand try operating the lever. This might take the pressure off the locking pins (which are usually tapered) and free the mechanism.
If the lever still doesn't move then the chances are it is a mechanical failure of some sort (rather than a case of simply sticking) and probably won't be solved without taking the stock off.

I've been shooting for over 20 years, Handguns, Rifle's, Shotguns & Machine Guns!
Always an advantage when -
1) The Family business is selling guns!
2) My Dad (RIP) has been into guns since before i was born
If it's a new gun, why dont you contact the suppliers or the maker personally, surely its not worth the hassle of breaking it further, invalidating the guns warranty & costing you more to repair

Mine sometimes does that, is it a Browning ?
Just give the lever some REAL force and it will move, I suspect you have **** in the mechanism that has stopped it closing properly so when its open give it a better clean.
