Speeding convictions and insurance, 11 points or 14 day ban?
Hi, my mate is in a pickle, he got caught speeding the silly oaf and was already on 6 points. Now hes going to court (98 in a 70 IIRC) and the solicitor said something along the lines of depending on how they deal with it in court he can get him a couple of different outcomes. 2 choices being
5 or 6 points and a fine (which will put him on 11 or 12 points but should keep his license)
or no points but he thinks he can wangle a 14day ban and a fine....
His question is which would be best for future use on insurance (bearing in mind he drives an expensive car to insure anyhow) so would insurance be cheaper with 11 points on the license rather than a 14 day ban (would you have to tell the insurance company about this?) or vica versa?
Thanks

Points is what he wants. Insurance will rightly go up somewhat. Get a ban and it'll go through the roof. And yes, you do have to declare bans to your (err, I mean your 'mate' ) insurer!

lol thing is when you go looking for quotes on insurance web sites it asks about bans and they start at 1 month not a 14day ban, its not like a dangerous driving 6 month ban conviction is it, thought it might be taken lightly, bit like how 3 points doesnt really effect insurance anymore but did a few years back.

ScoobyDoo, tried that, they wont give him any infomation until they know what his punishment will be, seems stupid really but I think they just can't be bothered running through 2 different quotes when they know there will be no sale at the end of it...
I thought the 14 day ban would have been best, still leaves him on 6 points and hes not going to be worried everytime he gets in the car about pushing the boundaries as he would with 11 points on the license.

go on confused.com and do some quotes.
I hope hes got a few £ks lying around. I know someone who got a 14 day ban for 116mph in a 70mph and then a month ban for 105mph in a 60mph. He is a right ****.

ewan, again, all the online places start their ban lengths at 1 month not 14 days, dunno if it'll give a true reflection on the prices, plus confused is a rip off anyhow

He should have his ********* connected to the mains for 1 hour per 1mph over the speed limit
AND
then banned for 6 months with a £2000 fine and his car crushed
Should make him act more responsibly towards society in the future!

I would say.... go for a 14 day ban. The penalty is at the discretion of the magistrate, but his solicitor appears to know the score and can steer the magistrate towards the desired penalty. He will pay some extra for insurance and it will affect which companies will allow him to hire cars for the next 5 years. However it's not the end of the world.
If he gets banned for accumulating 12 penalty points (either now, or anytime soon if "unlucky" enough to get pinged again), the ban will be much more severe. I think under the totting up procedure you can get banned for 3 to 6 months. I don't know your mate's circumstances, but that could be seriously disrupting. Does he need his car for work, or even to get to work? Could be bad.
When I got banned, I watched about 5 other cases being processed before mine. One guy had been caught twice just a week apart, once for 97mph and once for 104mph. His solicitor argued for points for the former and a short ban for the latter because his client needed his car to get to hospital (he was a doctor). He got the result he wanted.

I know the penalty is up to the majistrates but from what hes told me his solicitor said depending on how they plead he has a good chance on certain outcomes....
If it was me Id be trying to go for the 14 day ban myself as the other 6 points has only been on his licence for the last year so he'll be on 11 points for about 2-3 years. wouldnt like that myself. at least if he had 6 points he wouldnt be worried about being flashed by a gatso or something similar in the future.
