anyone know about claiming on ins?
A month ago someone drove into the back of my g/f's car. She was stationary, someone on m23 cutting in behind her and braking too late. She's got independant witness to say it was other blokes fault. other bloke admitted his fault at the scene.
Had the car assessed so know what needs to be done etc. However, awaiting 'approval' from ins to get the work done. Ins company are 'waiting' to hear back from other insurers (who've said other chap hasn't made a claim and haven't heard from him regardless).
What are her 'rights' as she needs the car sorted (minor damage but drivable) as she needs car all the time (shes a doctor) so would need a courtesy car while hers is being fixed (not avail on her policy but since it's the other chaps fault, surely they should pay/provide one). Is there a legal time limit for insurers. When are they obliged to sort things out one way or another?
Also, car is soon due a service and mot, after which she wants to sell/trade in the thing for a new car.

Your g/f should contact his insurance company directly and tell them she wants to make a claim directly on his policy since it was clearly his fault and she has independent witnesses. That should get their attention and start things moving. In a case like this there is no requirement to go through your own insurance, but you do need to tell them you have had a no-fault accident.
Since your g/f has already spoken to her insurance company it's probably a good idea to tell them she is doing this - just in case they get the hump.
