can anyone advice me on this please? i was on a dual carrigeway 70 limit (very quiet), came around a downhill bend to see a camera van in lay by. by time i slowed down it was way too late. i have a road angel classic with laser alert which did not go off but they do not detect laser under 200m if the laser is pointed at the number plate (the distance i was away i could only guess). i've always had a clean licence and it was just one of those moments when the foot went down for a quick rush of acceleration.
does anyone know how the offence is recorded, do they photograph the car and get pictures of the driver? or do they photograph the reg plate. it may sound odd but if this goes to court can the police provide proof on who was driving the car at that moment? as it might be more costly for me to lose my licence than for my partner who was also in the car at the time.
has anyone on here had any experience in these matters? or could someone point me to somewhere where i can read about this stuff in more detail.

1) prepare to get flamed by all those who do not speed.

2) I'd be very careful about putting so much detail about the incident on the web.

If you were caught they will send a fine/court summons (almost certain) and wont provide a photo unless you ask for it. This will show the whole car, and probably the driver.

Get over to pepipoo.com and see what they suggest. There are some get-outs which may well get you off, and are probably worth trying.

I think that's what's known as perverting the course of justice, probably not best to advertise it on a website.
I'm not going to have a go about speeding, we all do it from time to time, but if you get caught you've got to deal with it I'm afraid.
Oh yeah and just because you (may) have been doing over 100mph it doesn;t automatically mean you'll get banned anyway.

a certain mate i know has got 14 points on his licence and he aint been banned.

you go in guns blazing with an excuse as a defense, expect no hardship plea to be listened to, but i still stay the legal advice is the best thing for you

I would be VERY careful about saying it was the partner - as perverting the course of justice WILL get you a CRIMNAL record!!

Just wait for the NIP, attend court and pay up (it may actually just say something like 98.6MPH or something?)

There are many good defences that you can explore and one may prove suitable for you. As others have said pepipoo is a good place to start your investigations.

However, do not post the full details on any web site as the police and partnerships now monitor motoring related web sites for posts just like yours. I would also strongly advise against telling lies when, in truth, there is likely to be a perfectly legal and reasonable defence open to you. You also want to avoid offences like perjury as they are generally viewed in an unfavourable light.

In summary get advice on pepipoo and if you feel it necessary then you might need to take advice from a solicitor who specialises in motoring matters.

As a point of interest the 85th percentile speed on the German autobann is now almost exactly 100mph and they have an excellent safety record.

wasnt there a big case in Cumbria recently where someone got their g/f to say it was them driving, and then the divvy goes on the 'web' bragging how he 'got off' <until a cop who was a member of the site he was bragging on decided to *do some checks* and he now in jail??>

Perverting the course of justice springs to mind When they find out you were trying to pervert the course of justice you will do time. Its not nice getting bummed by an in-mate (so I've heard )

100+ is as faik an automatic ban, the time is dependant on many factors though,

if your names beckh*m or you have a top brief then its around 7 -14 days

if its smiff and a court appointed brief, then its your *** into slavery for the rest of

Mmm that's an interesting point about perverting the course of justice. Having been in court and successfully defended myself a few times over speeding allegations, and having had allegations withdrawn at the last minute, I know how the game's played. My experience is that the biggest 'perverts' as far as justice goes are the CPS.

Thought they had a minimum standard of evidence or a reasonable prospect of a conviction before even thinking about going for a prosecution? Think again. The usual rules don't apply to speeding as far as the CPS are concerned. Why would they? Speeders aren't your usual sort of criminals and don't generally know the intricacies of the law. So why not throw the book at them for minor speeding offences? The CPS pursue every speeding case vigorously even though in most situations there is not enough evidence, not even the name of the driver, because they know they CAN, and they do so many that the law of averages gives them a good strike rate. Much better than they can achieve prosecuting real criminals where they wouldn't achieve their monthly 'clear-up' targets in league with the police. No doubt there's some kind of bonus scheme or pressure from above to meet prosecution targets.

And before anyone gets at me for saying that, I am a public servant myself and I know all too well how Labour has rotted the public service ethos in this country with its obsession for measuring and publicising performance and making people jump through hoops to prove they are doing their jobs. Heaven forbid that we might actually just do the job because we want to put something back into society.

Anyway, back to the point. I have seen with my own eyes and ears that the police and CPS have no qualms about fitting up the wrong person for a speeding case, or at very best they don't know for sure who did it but their best guess will do. They don't care as long as SOMEONE'S driving licence is endorsed. 1 crime committed - 1 crime solved. Target met.

I was stopped by unmarkled police on M56 and recorded at 119mph. Went to court, obviously, and I got 6 points and £500 fine.

They said it was an instant ban but, as I pleady guilty, didnt hassle the police officer or the judge, and I had a letter from my employer stating I needed a licence for my work, they let me off with the points and hefty fine.

I had already 3 points at the time of conviction btw.

Bottom line is...if we get stopped for doing what is wrong in the eyes of the law and we are remorseful then we may be dealt with leniently...

Those who say they dont speed are either liars or they can't drive at speed anyway....we all do it at times but as long as it is controlled and safe then we shouldnt critise others...shouldnt critisise anyway as we all have choices!

this seems very simple.

IF you get a ticket then 100mph on a clean licence is very unlikley to be much more than a fine and points.

IF you lie about the driver you may get nicked.

Thats not very nice is it, getting your partner to lose her license for your own incompetence.... Wouldnt dream of asking the misses to take the rap on something like that...

Still surprising that your Road Angel did not detect anything, maybe they were having a cup of tea.

If they did, you might get away with the actual speed, speedos are usually fast anyway. I agree that it is just not worth trying to offload the offence on your other half.

It's no surprise that Road Angel didn't pick it up, the scatter from Laser is not very large and when they aim at your number plate and the detector is on your screen, it's amazing it ever picks anything up, indeed mine never did so I don't use it any more.

When was this oldmanmille? To my knowledge, having been caught at 116.5mph, the guidelines issued to magistrates are:-
90--> 99 mph, most likely 6 points and a fine, but a ban at magistrates discretion
100 --> 109 mph, most likely a ban, but it is at the magistrates discretion and can be given 6 points and a fine if it can be shown that you will suffer undue hardship
110 --> 119 mph, ban of between 2 and 6 weeks, plus fine
120 --> 129 mph, ban between 4 and 12 weeks IIRC plus fine

I pleaded guilty and my solicitor tried to mittigate on my behalf to reduce the penalty. He pleaded hardship, not able to get from my house to work by public transport, letter from my employer saying I needed my car for work and that my job was at risk if I couldn't drive. I was banned for 42 days plus a 250 quid fine.

So in short apac, it comes down to the whim of the magistrate you come infront of. I don't know how John got away without a ban, it seems out of step with current magistrates guidelines. If you can get the assistance of a specialist solicitor then it may help.

Someone i know got estimated speeding 90-100mph - outcome was 6 points (already had 3) and £500 fine and didnt need car for work etc.

Month later, they got stopped for doing 80 in a 40mph zone - outcome unknown yet but probably a year ban and a greater fine??
