Default Need help - quiting job / breaking contract can I do this?

Hi All

Im posting on behalf of a colleague who basically:

Is still on probabionary period as a Unix Admin
Has a 1 month notice period

Has been offered a new job that he really wants(contracting)

BUT.............they want him to start in 1 weeks time!

So......what can he do? just jump ship and say f11ck it?
Ask them nicely? and just go sick if they say no??

Will they pursue legally if he breaks his contract??


Any help much appreciated!

aye just pull a sicky for the rest of his time there, if hes only on a probationary they'll terminate his currect contract anyhow I should guess..... probably wont pursue him unless theyve paid him a fortune for something.

Well if he's on 1 months notice and still in probationary most companies would be reasonable if he was honest with them - to be fair they don't want to waste a months pay training a new recruit who they know is going to leave anyway....

If he doesn't think they'll be reasonable get him to tell them he's going to a competitor and then offer the 1 week notice.....

When I worked for one of the big high street banks we had a new chap who knew **** all (network design). Although in no way his boss etc I was looking after him for a while, explainign and training various bits. Spent a year getting him up to speed. As soon as he could blag enough to be dangerous he gave about 3 days notice and went contracting. We were all on 3 months notice. several people had left with 1 month after asking. Nothing was done to him. (and its not as though the company was short of resource if they'd wanted to pursue it)

BUT. "IT" can be a scarily small world. A few years on and everyone's moved on slightly. I've recently been recruiting for my current firm. And his CV passed my desk. I wanted to get him in for interview just to see the look on his face but in the end we were short of time so just told the agency no....and then pointed out the blatant lies on his CV from his time at the Bank. In all I was sent 10CVs by an agency. I managed to find someone I knew who had worked with them, for all but one of those contractors.

Be careful of the bridges you burn by lieing or just walking out. I honestly dont think anyone is going to get too upset about someone asking to go on their probationary period....so long as they're honest. Person likely to be most pissed off is at the agency that placed him for the current job
