Arrow Help Please!!

Received a threatening voicemail yday from an associate at work. I have been accused of something i havent done.

Now, dont want to go into detail, but the woman who listened to the voicemail works for connexions, and she informs me it qualifies as verbal harassment.

Now, if this is the case, what are my rights?Im definatly leaving, its a small company so wont be able to avoid him if i swapped supervisors etc. So no way i am going back.

What are my entitlements or where do i stand?

You need to report it to soomeone senior to him, and ideally if you still have the message on your voicemail, let them listen to it.

Also, I'd transcribe the message so you have a written record of it.

You should make an appointment to see your most senior manager and let them listen to your recording. They should suspend him whilst it is investigated, and depending on how threating this is, I would imagine this would be classed as gross misconduct and therefore dismissal.

It would be easy enough in a large well organised company, but as Price says he works for a small Company. Many of which have no clue how to correctly handle things like this. The neither have the skills nor the legal knowledge, so tread carefully. everything above board, good idea to wrie the message down ands then see the boss as suggested.....

if your looking to leave on the grounds of constructive dismissal, you need to go down every route possible before hand, or you wont get anything from a court.

you need to ask this persons boss, or the most senior person available what you need to do to set a grievance procedure up.

you need to try and get a hard copy of the telephone answer message, or get someone else out of the loop (solicitor) to listen to it and write it out and then sign to confirm they have listened to it and it is them that wrote it out exactly as it was said.

Surely your boss has the responsibility to sort it out, if he is any kind of a manager. If he can't do it then take it further.

This is tricky in a small company of that there is no doubt. Are you a member of a union or similar organisation? Many unions will provide free legal advice. Even if you are not a member of a union then some solicitors will provide a free first consultation which might point you in the right direction. In saying that it would be worthwhile trying to get someone who specialises in employment law rather than someone with just a passing knowledge.

If this becomes a problem then you should be aware that harassment is also a criminal offence but to get a conviction you must report it on 3 occasions, as I recall. The police have the power of arrest in harassment cases. I am aware that this may be a route you would rather avoid but it does give you an option should you feel under threat.

The other question we have to ask is if there is another side to your story? If you did someone to cause this person to leave the message, for example, then it is possible that they have been gathering evidence on you in the mean time.

The new 3 step process which came into effect on the 1st October 2004 states that you must give your grievance in writing first, before you do anything else. Your manager then must set up a meeting between them and you. It is very important that you write your grievance down - it may effect things if you take it to court.

It will certainly affect the outcome of any subsequent employment tribunal.

Shaggy is right defo go to ACAS after getting all the evidence compiled and collected as someone else said hard copies. I hope you all the best. Work is a mission without at the best of time let alone when you are getting harrassed.

ACAS know exactly all the correct avenues also consider a solicitor...but that could be expensive. My boss currently paying £300 for every letter drafted in her work issue!!!
