My insurance claim finally settled!
Almost a year later my claim has been settled with a 50:50 split, obviously i lost my ncb (only 1yrs mind!) but my insurance has gone up £700 this year!
My being sued post!:

The visit from the MIA:

I never did fill in her solicitors forms and send them back or take the Unions advice, i sent them back to Tescos as suggested on here and as instructed to do by Tesco themselves!
Ultimatley im £1400 out of pocket though as not only has my premium gone up by £700 but my combined excess also came to £700! More than the value of the other car i might add!
Now im driving with the eyes of a hawk as i want to get this £2000 premium back down!

They said from the photos showing the damage to the other car it would be hard to prove it was their fault, and a 50:50 split would be the best option as if it went to court they would rely on the photographs to determine whos fault it was.

I think a lot of insurance companies seem to do that now as it saves them the costs of going to court and both parties take a hike in their premium so the insurance companies get back the money spent on repairs. When you think about it then it is a cheap option for them and an expensive one for you so it works to their favour.
