Red face warning about posting on the internet

Surely you just say, I was only bragging and lying to make me look good infront of my mates.... ??? they cant take that as real evidence... can they?

I shot my noisey neighbour last night, git kept me up most of the night so I shot him...

Will I be arrested now? Think its wrong if you can be done for something like a posting on a car forum

Don't specify a unit or make one up then they can scuk your d1ck for their prosecution.

Last time I was in the UK I drove at 130fatdonuteatingpigunits on the motorway so **** you speed police.

The pending prosecution of the young lady in question has nothing to do with talking about going several squillion miles per hour on a road, however 'private'. The lady received the NIP and informed the courts that she was driving, when in fact it was her boyfriend: so she lied on the NIP. She admitted she lied on the forum, and is being prosecuted for 'perverting the course of justice'; making sure the correct person is prosecuted for the 'crime'.
Will she get off the speeding fine, as they now know it wasn't her driving?

There is no way a prosecution can me made unless you admit it to the police and sign said confession. A post on the internet firstly doesnt necessarily have to be you, secondly you can happily say it was a post to see how people reacted to a theoretical situation.

Any intelligent defence would stop this prosecution stone dead.

Geezer, no they aint but theyre prosecuted with evidence... posting on a public forum is not evidence IMO... most of what gets said is bull...

c'man, how many threads are on the saxo OC boards saying I cained a scooby off the lights the other day up to 100mph we all know its not true (unless its a well modified supercharged saxo) so does that mean hes going to get prosecuted for it? its not evidence...

It isnt evidence, its hearsay and its worthless; but if they dont have the sense to not make ANY comment at all then thyre f*cked.....

Despite what me may or may not believe, surely the only question is, do we believe what she has posted?

If so, then obviously it IS enough evidence. The police are not that stupid.

I love the fact the stupid cow hasn't learned her lesson:

Basically a speeding ticket came through for my car in my name so I paid it and took the points even though I was not the driver coz its just a ticket right? Then I very stupidly posted a topic ranting about how i was getting points when he was driving in a fit of temper which was printed off by a member, given to the police and yesterday we both got arrested and charged with Perverting the Course of Justice.

I would think they (the police) confronted her with the screenshot and she crumbled and 'fessed up. The text itself is not sufficient evidence.

Just goes to show you cannot trust anyone these days! Somone obvisouly thought it would be "nice" of them to show the police the thread, that or one of the members is a police officer and decided to take action.

It would not suprise me in the least if a similar thing happened on here.

Actually it's not hearsay: hearsay is when you repeat something you heard somone else say. (Needless to say it's more complicated than that, but that's the general gist.) In this case the woman wrote it herself, so it's not hearsay, whether it is true or not.

Yet again another good point. A good friend of mine registered on clubgti and another friend found out his password, if you look at his posts (I'll find them) it's clear that my mate didn't write them if you know him but if anything was written wrongly about him by anyone of a number of friends with his password he'd be screwed.

He doesn't know what his password is now to change it btw and I can't guess it to help him either.

My understanding is that something typed on an internet forum could be taken as a voluntary confession under PACE. I did warn about this in some previous posts where people were careless with what they had said, and in most cases they had the good sense to delete any material they may have posted in error.

I also suspect that, as this confession was made on the forum, other members of the forum could be considered to have been in "receipt" of the confession. Now I am far from clear on the exact powers PACE would allow in this case but would suspect that other members of the forum could be questioned or asked to make a statement regarding the confession. Under such circumstances it may be possible to prove the involvement of an individual at least to the level required to convince a magistrates court and clearly in cases such as that detailed there is the potential that the individuals involved may make statements implicating themselves when questioned directly by police.

So, while there may be argument and counter argument on this issue and while it is very possible that my intrepretation of PACE is far from watertight it would be worth considering any confession of a criminal act made in public as a confession to police under PACE. That way nobody drops themselves in it and errs on the side of safety.
