Default customs seizure

I have had a container of good seized by customs they say the goods are labelled as genuine but they are copies i cant go into to much detail but the goods in question only take up 1/4 of the full load all other goods are 100% ok

I did not buy the goods with the intention of passing them off as genuine and i did not think they would be labelled as genuine anybody offer any advice on this

I have seen the goods for sale elsewhere and although they are labelled in a similar style the name is spelt different

Customs have been a real pain in the neck for me recently, I have had 9 out of 9 containers xrayed (supposed to be 1 in 5) and the most recent was broken open by them (at a cost of £75 to me plus dock storage). From my experiance and what I have been told if you have a problem with one container, they will also go back through every container you have ever imported with a super fine tooth combe.

Can your clearing agent not offer advice? I would of thought they would of had or can recomend a solicitor for dealing with this (or at least some one who can act on your behalf). I have only just finished speaking to a friend of mine who said and I quote "dont hassle customs otherwise they will make the rest of your importing life hell!" best to get an intermediary to help sort it out the goods have got to go some where I wouldn't of thought they would destroy them all if theres nothing wrong with them.

The clearing agent is a bit unsure what to do they are used to having cigs booze etc seized but this is a bit different as i say the goods may or may not be labeled as genuine i really dont know as i cannot see for myself but i don't feel i have done anything wrong

they say if i dont respond in 30 days they will destroy everything!

I ordered the good in good faith i did not order counterfeit goods

surely someone can offer some advice

You will learn quite quickly that ****soms and excise can do what they like and when they like.

They froze all my bank accounts over 3 years ago without any hearing/trial/just cause.

Have a legal team but they are unable to do anything until HMCE decide they want a hearing (if ever!).


I think it will be a case of burden of proof on your part. You will have to prove that you purchased genuine goods (or at least tried to). You may then be able to argue the return of the non-counterfeit goods.

If your clearing agent has no experiance of this before then maybe there not big enough or experianced enough? This goes on all the time especially with goods from china (Im guessing thats where these are from?) I would personally start by ringing round all the big clearing agent companies to see if they can either suggest some one who can help or if there own company can help you. Dont dilly dally you need to get this sorted asap before customs get its wheels fully in motion. An hour on the phone ringing round may just save you.

I would guess customs dont want the hassle of seperating the goods from the rest of your stuff in your container, its alot easier for them to just seize the whole lot. Do you have or can you get sample DHL'ed to you? you can then possible deny liabiltity some how, if the samples didn't say genuine?

You need to get representation asap with the amount of containers that come in to this country there must be people who are specialised in dealing with this.

Well thats what i thought I know it happens all the time i have samples of the goods that i know are ok no way of getting a sample of the alleged counterfeit as they are too big!!

I have pictures/specs of what i ordered and i am going to gather them together and see what i can do NOWHERE does it mention the name they claim is on them!

To be fair the clearing agent has been very helpfull but i feel the bosses at the co want to distance themselves from it for some reason although i may be wrong
