Has anyone ever got out of a phone contract

Default Has anyone ever got out of a phone contract

i renewed my contract with vodafone two months ago, went to a higher tarrif and got a v3, after a month it wouldn't recieve picture messages or video and was hit and miss with texts,
now when i've asked for a repair they say they will only supply me with a reconditioned one,
it came this morning, looked like it had been stepped on, with kinks in the metal number plate, it wouldn't even close properly. i tried to text on it and the texts wouldn't send i phoned vodafone, got a stroppy supervisor who said another reconditioned phone will be sent out, "take it or leave it"
i want to end the contract now
can this be done

Is it a network problem or the phone?

Surely the phone is under a 12 month warranty.

Write them a letter, you can spend all day on the phone to these types of places but a well written letter can often sort it out.

they say its not a network problem!

also said i only have 14 days to report a problem about the phone from new after that all they can offer is a reconditioned phone

your right about spending all day on the phone to them, i'll try a letter

What they say and what the legalities of it all are vary wildy. You are talking to someone with basic training and at best a vague understanding of the legal situation.

You have 14 days to cancel the contact under distance selling regluations as I understand it.

As for it being a network problem, test it, use this dodgy reconditoned phone or try your sim in a friends phone for a while and see if the problem continues.

A handset will almost certainly be warranted for a year just like any other electrical device.

I assume you don't have insurance with them then? Take it out, check it covers loss or damage and then mistakenly damage or lose the replacement phone.

Try the local trading standards office to the shop where you bought the phone (might be Newbury if it's Vodafone's website). I found them to be pretty helpful with trouble I experienced recently with a phone contract.

Utter B@ll@cks! Like any other piece of electrical equipment your phone has a years warranty. Contact Vodafone and tell them you are forwarding your complaint to the phone's manufacturer. Vodafone tried this on me and that worked. Stupid thing is that as the phone is under warranty its the manufacturer who foot the bill, Vodafone don't pay a penny!

I was having issues with SinglePoint / Vodaphone a while back.

Didnt matter how many times I called or who I spoke to, all I got was "tough, pay us what you owe us"
I didnt actually owe them anything, they had continued to charge me for a contract I had cancelled.

I spent a bit of time writing a letter that simply explained all the facts. No ranting at them, no demanding anything, just leaving it open with something like "...I look forward to hearing your resolution to this matter"

Got a nice letter back saying the contract was cancelled and they had written off everything I "owed".

ive had loads of problems with my vodafone txts dont always send and the same with the pictures i wont to get out my contract i think you have to pay up the months that are left.

You normally deal direct with Motorola or their service agent and they either repair or replace the handset providing it's not over 12 months old.

Iv'e noticed this with my phone's of late, friend's send me text's, and sometime's they don't turn up until the next day. I tried it with both my phone's (sent myself a text from one phone to the other, it took 3hr's to turn up), it does'nt seem to matter what network they come from, it's just vodafone being ****e, iv'e just upgraded as well, but i'm stuck because vodafone is the only network that work's where i live (very remote). Vodafone used to be really good, but i think there going downhill very fast.
