Legal Opinion - Will dispute
Hey, this is on behalf of a friend:
A number of years Great-granny Mrs Miggin's dies leaving a house in her will to Mr Joe Blogs stating that following the death of Joe Blogs the house should be passed in ownership to Mr Starburst.
Mr Joe Blogs however was a lazy git and never bothered to get a will written out but had always understood and agreed with the wishes of Mrs Miggin's that the house pass to Mr Starburst upon his death.
Recently Mr Joe Blogs passed away and with no will stating his wishes his brothers and sisters stand to get an even share of his estate including the house that he took ownership of following the death of Mrs Miggins. Mr Starburst is getting nothing.
The question is this: In light of the lack of a will made by Mr Joe Blogs does the previous will of Mrs Miggins remain extant? Does Mr Starburst have any right to the house or a share of it.
Opinion appreciated. Btw, these are all real names

sounds like the house wasnt left in trust to joe for his use but instead left to him outright with the hope he would do the "right thing" later on...........joe was lazy and couldnt be arsed to do the right thing so his estate passes under the intestate rules - and not to Mr Starbucks.
