Happy Brithday to the PACE witness statement over on Mika's pepipoo site. The statement has been on the site for one year today and to date no one who has used it has been convincted of any offence.
Well done to Mika and good luck to anyone else who cares to protect their rights to silence and not to incriminate themselves.

A colleague of mine has gone down this route. The reply from Essex police is that he is to be prosecuted for a S172 offence AND the original speeding offence. Not sure how they work that one out, I'll let you know what happens.

Well if the people that be decide that the PACE letter is admissable, then you can't get prosecuted with failure to supply.
However having *nearly* got my head around this PACE letter thing, I'm not sure I agree
Would it not be part of a "deal" the CPS put to you, just before you go before the JP's, that you admit to speeding and they drop the 172.

Got a date, yes.
There are other things going on here too, like they maintain there was a telephone conversation between me and an investigating copper...........but my phone records show that I didn't call them, so if they called me, how did they get an ex-D number? I can truthfully say that no such conversation took place, and I believe they will TRY to say that it did, and that during said conversation, I was given my rights under PACE.
But first I want to SEE them prove it did take place!
I'm sending in an ng, btw.
