What about "I don't trust the Americans to get the "evidence" right and they shouldn't have locked up these poor sods for 3 years like they did"

oh yes,those poor sods that went to the Spar for a pint of milk but accidently found themselves in Afghanistan pointing a gun at the Americans.Personallly,I don't see what all the fuss is about,suspected terrorists were interned for much longer in NI.

Tend to agree with you on the Pakistan and African one though. Still not quite sure how they ended up being passed to the US without any evidence having been found at that point anyway. If there was evidence why wasn't it used to press charges?

From my point of view, my option would make it fine for the suspects to be handed over for extradtion to anywhere - like I said - it's up to the countries concerned how to handle them (or pass them on).
Yes, being caught in Afganistan when the taliban were "in power" would mean you would be at the mercy of the American legal system (the taliban weren't recognised as legit by the UN)
We don't know if charges were filed under the rule of law that applies at Guantanimo, but they were held under US law charged or not
