Had a day in court today...
Not as a defendant but in the public gallery! Thought I'd pop along and see "Justice in action". Situation is basically 1 female housemate sitting on sofa, 1 male housemate comes over sits on her lap, "starts bouncing" on her lap suggesting sex - shes having none of it gets him off, then he punches her twice on the **** and once in the face. Next day she goes to the GP and he says there is some damage to her head and she has a cut lip. No other witnesses, his word against hers, and she admitted to falling down the stairs a week before. When the guy was interviewed by the police he said dont know anything about it and cant remember the evening.
If you were the magistrate, is he guilty or not guilty?

Not.
Truth is he might be guilty and he might not, but if there is no evidence to prove it one way or the other, surely the only verdict you could return is not guilty...
Innocent until proven guilty as far as I thought...

A few more guesses - and I'll tell you how it turned out and why

Im willing to guess he was prosecuted quite heavilly, although its hard to say without knowing their previous convictions - if any.
The one and only time I have been in court was many years ago for some driving offences. Fairly minor stuff really. I had to sit through several other cases before mine was called, mostly burglars, one guy atempting to defraud his insurance company, and an assault. The burglars and the assault guy were all what i would term "proper criminals" huge lists of previous conviction, the burglars houses were found full of tv`s videos etc, even though they had no jobs to pay for stuff.
At the end of the day, those found guilty before me were fined on average about £75 each and given several months to pay it, and another line was added to their list of convictions. I, as the generally law-abiding motorist with a job, was fined many many times more than this amount and was given two weeks to pay.

He was charged with common assault (this hasnt got a prison sentence penalty) - although it could have been ABH. Not sure why it was reduced, there was enough for an ABH apparently.
He was found guilty - mainly due to the fact I think he "suddenly" remembered a whole lot of stuff in court which he didnt mention in interview. Also he refused to answer some of the prosecutors questions in court and looked like he was going to kick off at one point! Found out afterwards that apparently he was in the house cos he had been kicked out of his parents place for beating them up....
Sentencing Adjorned for PSR (reports).....
