a lot of things really. circumstances, voluntary statements, willingness to pay back the money, clerical error in the prosecution case, jail might exacerbate his medical condition, you have to be really carefull when doing these guys, i know coz i used to recommend prosection files to the RUC (PSNI) under the Fraud Act when i worked for the dole. CPS usually have no idea about benefit fraud and can usually be fobbed off with a sob story, and as to sentencing well that is at the whim of the judge, but i would say less than 1 in 100 sucessful prosections ends in a custodial sentence.

One near us has recently been convicted of stealing £15,000 in housing and other benifits. He got 40 hours community service


Reason?

Apparently he'd already started paying it back!

Compare this sort of sentence with people who reglarly get fined £200 for failing to disclose, whether they can disclose or not!

And the guy who was imprisoned for a year for a first offence of plotting to set fire to a fixed scamera

A friend of mine got done.. for benny fraud

he was waiting at the dole office at the time pleading poverty.. with a brand new 36 in tv on his lap!!!


he had to pay it back at 50p per week..

his kid was 18 by the time it was payed off!!!!
