Default Has the Boss got the new lad over a barrel

New lad used to work at the local shop until he got caught for "giving away the goods" if you know what I mean.
Some sort of disciplinary hearing later and he's out on his ear.

Our boss (the Lads Uncle) decides to give him a chance at life and asks him over to us for an interview.
In the interview the lad is told he'll be put on £4.00 to £4.50 an hour.

Pay day comes round and he's been paid only £3.75 an hour !

WTF! that's a bit off isn't it?

Knowing our boss (should do, been there 7 years) he'll swear Black is white and say he never said that price at all. (or something to that effect I suspect!)

It's not like the kid has many options open like "stuff the job you tight ****" as he is unlikely to get glowing references from the shop.

How best to tackle this?

minimum wage is a lot higher than that i think?

He gets caught for theft employee, is given a second chance and is then complaining about his pay??

Main (adult) rate for workers aged 22 and over
£4.85 per hour from 1 October 2004 (an increase from £4.50 an hour)

Development rate for workers aged 18-21 inclusive

£4.10 per hour from 1 October 2004 (an increase from £3.80 an hour)

Sorry not clear in my first post.
Lad used to work at a shop... got fired, full stop.

Joined us, a fabrication company, nothing to do with the shop..

Oh and school leaver, erm 17 I think.

Has to be supervised when operating machinery here anyway.

He's quite good actually can weld better than his Dad already.
(yes quite a few of his family work there )

Was he 'told' about the 4.50, as in, was it a verbal agreement? not sure how 'legaly binding' a verbal agreement is. What I would have done, if I was offered the job, would be to ask for a written offer, in which the pay rate is listed, have have the offer signed by the boss. Thus, in my eyes, I've got proof of what was discussed and offered, so the boss can't claim otherwise.

Under 18, I'm not sure there IS a national rate, and if he's an apprentice, he could be on less.

My lad's a welding/structural apprentice, at 18, second year and gets £3.99 an hour:

I think if I was him I'd do a kickass job for a while on that rate (you said he's got talent) then when I was 18 or so with a few months behind me go see the boss and ask for decent money. If he says no the lad's got some experience and can look elsewhere, where he'd at least make best part of £5/hr. I just think sometimes it's best not to cause ructions when you get an opportunity to learn a skill that could set you up for a job.

Personally, I don't think that the lad should accept being paid less than minimum wage. It's illegal for the employer to do this, apart from anything else.

A new rate for 16 and 17 year olds

The Government has accepted the Low Pay Commission's recommendations for a new rate for 16 and 17 year olds (above compulsory school leaving age).*

£3.00 per hour from 1 October 2004

NB: 16 and 17 year old apprentices will be exempt from the new young workers rate.

Oh - in that case he should be thankful that he's getting £0.75p more than the legal minimum. He only has to last out until his 18th buirthday, then he can go and ask for a rise.
