Possible prosecution

Possible prosecution
The other night I came across a cyclist with no lights cycling the wrong way down the outside lane of the Motorway. I was in the outside lane at the time and missed him, but he was hit further up the road by 2 cars. Last I heard he was still alive in a critical condition. This got me thinking, cause I may have been speeding a little, would I have got prosecuted based on the fact that I was speeding if I had hit him.

1) Why worry about what might have been? And seriously, what would you expect the outcome of a cyclist rding with no lights on in the outside lane of a motorway?
2) They could prove it by doing a thourough accident investigation which always happens in a serious injury or death related accident.
3) If they could prove you were speeding, they would probably prosecute. I find it hard to beleive they could ever point the finger at the driver and claim that had the driver been doing 70mph the guy wouldn't have died. In fact, I'm suprised he isn't dead already.
And Damo, you think he's a **** for riding without lights, not for riding the wrong way in the fast lane of a motorway?

LOL.
Yeah Im surprised hes still alive, and I would have thought anything above about 40mph would have killed him, so would have thought speeding was irrelavent.
