Red face

ok, cooled off now,

Police were informed at the time, my wife, bless her nearly yanked the other woman out the car cos she was so mad and all the other woman could do was say "its all right its only an accident lets just swap details and leave it at that"
Yer right, so my wife called the police straight away and within 15 mins or so they had 3 traffic cars there, they blocked off the road, i arrived before the police as the accident was only round the corner ish, in scooby of course (cos im a lazy sod sometimes) only to find the woman frantacally fiddling with her phone, so i asked for the phone and she said "why ?" evidence i said as u were using it at the time.

She then had the ***** to say " the fone rang so i took it off the dash and dropped it, i didn't answer it..honest".....WTF woman, did u not see any tele / radio adverts in December....??????????

Well the police tok the phone off the woman but she had cleared the memory, so there's no details logged of her making a call or sending / receiving a txt. (big sign of guilt if u ask me)

so they then breath tested them both, and both past, took statments from as them aswell, they policewoman told my wife that she would report back to her superiors and then decide whether or not to prosecute the woman for driving without due care andattention.

So i now left with a fooked escort, as only TPFT on her car, so gonna spk to the police later when i take all her documents down, and see if they are going to do her, i think i have a good chance of claiming off her insurance, because she admitted to the police it was her fault, cos she dropped the phone on the floor. stupid fooking daft cow, she might now think twice about picking her phone up next time it rings

Glad everyone is ok. Reckon the husband is comming round to try the intimidation tactics.

The Police should be able to get the transmission records for the phone from the Mobile provider..

I doubt that, but in case he is have a camcoder running in the background to record the conversation. In fact do that anyway, it will make great evidence whatever he has to say.

Yup, they "should" be able to get this info off the network provider as it's all logged.

Push them to throw the book at her.

Doesn't matter if she cleared the memory or not - the phone company will have a record of the call, that's how the bill you after all! The Police can easily find out.

Had experience of this type of accident where the driver was utilising the phone.

The Servcie provider ecords WILL show if she was either on the phone or had ACTUALY sent a text at that moment.

GO for the jugular on this. There are too many numpties on the road that do this kind of thing. Likely to be the first one to whinge about fast cars and how there should be more scameras.

I see this on the motorway all the time, usually young girls with the phone on their laps texting away while passing a 40 tonne truck, their risking causing a major accident for a stupid ******* message ,it makes my blood boil. The police need to really clamp down on this.I would even make it illegal to have a phone inside the car if it doesn't have hands free!
Glad your wife and child are okay mate and hope you push the police for a prosecution.

The Cellsites That the phone used before the accident should be able to nail her, should the police decide to prosecute. Should be able to say weather her phone was ringing at the time of the accident as well. Its the same system that was used to nail Ian Huntley as he decided he needed his phone with him while going about the business of murdering kids.
Glad wife and sprog are okay, take her to the cleaners, then she might not do it again.

The problem is : if she was just picking up the phone to read a newly received text message, or was in the process of typing a new text message/reply, BUT NOT SENT IT, then there won't be any record of any of the above on telco's records.

Hopefully she just sent one minutes before the crash so I guess they could perhaps prove she was driving while using the phone, but I'm sure a good solicitor would argue that she had pulled in for any text msgs minutes before, and if no evidence to contradict this, then tricky.

Hopefully they can prove something. I nearly got taken out by a HGV driver using his mobile a few months back who turned across me thinking the lights were for him and against me.....was quite disappointed in the HGV driver given their usual image of high driving standards.....

Push hard on the very suspicious behaviour of her desperately wiping her memory before giving the phone to the police.

I HATE PEOPLE USING PHONES WHEN DRIVIN !!. This is a method i use when i see one on the motorway, bit drastic but its funny.

1. pull up next to them
2. swerve as if you cant see them and push into their lane
3. watch them **** themselves and drop the phone in their lapand swerve all over the place.

as i said a bit drastic. but what do u expect when ive had two people hit me while bein on their fone!

M444GY, you'd be hoping that they weren't too engrossed in their phone, then????

Dying to know what the hubby wants, Dazza!

She's admitted it to the old bill so at least you will get 100% from her for your wifes car, does your wife have any signs of whiplash???

Trucker Ted, bang on, its always young girls texting, driving f*ckin new shape Minis, blokes tend to blatantly hold the phone to thier ears, especially if drving a silver 03 reg Merc.

Dazza, hope you get it sorted, bloody annoying.

I know its an offence to be talking on your mobile whilst driving.

Texting though is OK.........

Also playing Bounce is OK.

I think texting and eating a BigMac is illegal, but Im not sure. I was told it was only a problem if you crash into someone.

Taking photos of yourself with your mobile is OK when driving, so long as your not exposing yourself.

Now I know this is illegal, so take note: Passing a mobile phone from one moving vehicle to another on a motorway is an offence.

I used to smoke many moons ago, and smoking and using your mobile when driving was quite tricky, but I dont do that anymore.

Hope this clears a few things up.

PS. If my phone rings when Im driving I answer it, if I recieve a text I read it, if I want to reply, I reply to it.
If my CD want changing whilst driving, I change it.
If my window wants opening whilst driving, I open it.
If my rear view mirror wants adjusting whilst driving, I adjust it.
If my passenger speaks to me whilst driving, I will converse with him/her.

Is this illegal? If not, why not.....Your driving down the motorway chatting to your passengers, whilst smoking. Whats the difference between this and talking on your mobile?

How many people drive with two hands on the wheel MOST of the time?

Not me, my finger it usually up my nose MOST of the time.

Incorrect. Texting is also illegal. Using the phone in any way that involves touching it is verboten, so that rules out playing Square too...
