Help with speeding offence?

Question

I got stopped by the police the other day for speeding, the copper was in a plain ford focus, which he had stuck a light on the top, there was no photographic equipment in the car or any type of speed gun/device, he said that the reading on his speedo was showing that he was doing 60, we were in a 40 at the time, so he made the assumption that I was doing the same and kindly issued me with a ticket, is he able to do this??? Any advice would be grateful.

No way mate! if he hasn't got a calibrated speedo in his car or any other method of getting your true speed your in the clear. Just make sure you write to the CC and ask for a readout of the claimed speed, or a copy of the log book for the calibrated speedo, and when it was last calibrated.

If it was a designated traffic car with a calibrated speedo, yes. Although, without a 2nd officer to varify and no other evidence, it's your word against his. If you go to court, get there early and aquire the services of the duty solicitor and question the validity of his claim and the calibration of his speedo.

If it is a traffic officer that stopped you, a certified speedometer is all that is needed to coroborate his evidence if he is on his own as traffic officers are allowed to give expert opinion of speed. The downside is that the following distance must be for a minimum of 2/10 of a mile.

If it a plain general duty car, again there is nothing to stop him doing you for excess speed on a following check, however the speedometer must be checked for its accuracy against a certified stopwatch over the measured mile as soon as possible after the offence was committed. This check must be included within the evidence.

A speedo on a traffic car is usually checked every Sunday over the measured mile, and the details are entered into the log book and on a speedo log held at the traffic base, but unlike general duty vehicles traffic cars are often allocated to 1 officer or 1 crew.

If it was a divisional officer that stopped you (the ticket he gave you will identify where he is based or what department he is on), then you may have a reasonable case but if it was a traffic officer, you are probably pretty well stuffed.
