Question

There is a stretch of road near me which has been in a bad state of repair for a couple of months. It has become so bad that I have to go on the opposite side of the road to avoid crashing down the potholes. Well this morning it caught me out and I now have two badly scratched P1 alloys. Can I claim off the council for the damage and if so how do I go about it?

The council have a duty to ensure the condition of the roads. Ihave had about 4-5 claims all payed out without any real fuss. Some insist that they have 3 -4 days after a road is damegd etc to make it good.

Its free money.......!!

Chances are you can claim. You need to get pictures of the potholes ideally with some sort of measure to get an idea of depth/size. mind the traffic though!

Go and get pics of the potholes with a rule in it for scale. Most councils have a minimum pothole depth before they will consider a claim. 10cm seems to ring a bell?

The council only has to show thier report for that road indicating they know about that pothole and have plans to repair it and they will not pay out.

AFAIK they do a report on each road once a year.

Did you use a solicitior or just get in touch with the council directly?

Straight in....Small claims court form faxed to them. They wont go to court unless your claiming ££££'s

Digital pictures are not acceptable in Court if that helps.
