Just suppose that someone had been charged with an offence. Then he/she is aquitted due to an alliby provided by another person. Then the alliby is shown to be total bollox. He/she is then tried for perverting the course of justice. IF he/she is found guilty of that would he/she then be retried for the original offence ?
If not, then surely the sentence for perverting the course of justice must be equal to the maximum allowed for any offence.

I think double jeapody only works if there is no new evidence to present.

In this case there would be new evidence, i.e. that the alibi was false so the original case could be retried. I think.
