Drinking and driving: 2nd time, 2x over the limit

*Once could be called a mistake or bad judgement call, twice is stupidity of the highest order and must demand a custodial sentance to get the point across to the offender and others.
* assumes no-one is injured or such by the person, if they are involvwed in an accident the an automatic custodial sentance, no-matter the circumstances

They will know he's been disqualified in the past as his anticedents will be part of the file sent to the CPS, who inturn will pass it onto the Court.
As mentioned, courts are a bit of a lottery. Def. 3 year ban, maybe 5 with an extended driving test when he can re-apply for his licence. However, there is good reason to lock him up, even for a week just to bring him to his senses.
No time or sympathy. Just pleased that the court aren't hearing a death whilst driving with excess alcohol. Lets hope he'll learn his lesson this time (probably not ).

But someone I know.
He is a 100% guilty and deserves what is coming. he will be up against the same judge as the first time. less than 2 months after getting license back. As title both time he was over twice the limit. he is single. Court to sentence theis week.
What will he get ( he deserves it) what sort of problems will he have driving/ insurance in the future.
Feel free to have a pop at him.................

Luke i know somebody who was in the same situation, had some real bad personal problems, the only way he skipped going to jail was by getting some really good referances and promising to go to AA for his drink problem. If your friend is just a **** head who can't keep his *** out the car when he's had a few then tell him to expect a jail term, If his parents have just died he may be lucky as my cousin was.

Hope he gets put away, mind you, free bed and board, good meals, tv, etc isn't much of a punishment.

* My mates brother got banned for drink driving then got caught drink driving while banned He got a 5 year ban in the end and now has trouble getting insurance.
* Girlfriends ex friend got banned for drink driving, got her licence back then got caught again a couple of months later I can't remember what happened to her at the moment though
It's likely to be a big ban and major headache getting insurance after this

If it is the same magistrate I dont give much for his chances. He deserves the nost swingeing penalty IMHO, innocent people need to be protected from irresponsible behaviour like that.

I am currently banned.. there are circumstances which I wont discuss on board.. Would I do it again? Would I ****. I would say you learn by your mistakes, others dont..
Expected Sentence..
5 Year Ban, Likely to need retest.. as no penalty when stopped then no prison.. had they been banned and speeding then prison?
Are they allowed to see that he has been banned before??
I seem to remember watching on the news about some kiddy fiddler that didnt get prosecuted for something as they couldnt say that he had been in court for it before?

tit,once is bad enough ,but twice,i'll bet that he has done it many times b4 getting stopped ,car should be taken away and sold or drink drivers should have to have some sort of recognition on the no plate or a yellow l plate !!

I'm glad I havent talked to him!!!! I would have to walk away. And yes its a regular thing Drinking then driving for him. Out of 10 Of his friends 8 are banned for same thing. I use to live next to him thats all......... he is not a "Mate".
And yes I think he will do it again............. and whilst been banned. But I am sure the local Police have him covered.........

When he has been convicted the magistrate will be told of previous convictions before he is sentenced. He is allowed to make his excuses before sentence is passed-much good that it will do him!

Brother-in-law is a tw*t and has just gone through something similar.
Twice over the limit, hits another car and tries to do a runner on three wheels. Gets two year ban, 20 hours community service, looses his job and marraige breaks up.
Goes on drink course and gets his licence back after 18months.
6 weeks later gets done again for drink driving.
He now has 3 year ban and 100hours community service. Magistrate said he was very lucky to escape a custodial sentence.
His current girlfriend has given him a choice, give up drink or she is leaving. What does he do when she tells him? He goes out on a bender.

Some people never learn - while living in Tenerife, my mate Paul was caught drink driving 6 times in 3 and a half months.
As the Guardia Civil don't know if he's a tourist or not they just fine him the equivalent of £350 each time.
My Dutch mate got stopped too and as he didn't have enough cash on him they made him drive to the nearest cash point and withdraw the money.

It goes the other way too. I was having a drink and knew I was slightly over the limit. I was getting a taxi home with some friends. Two policemen overheard me say that I need to go and get my jacket from the car. They followed me and breathalized me. I was arrested and accused of attemting to drive while over the limit. I was just marginally over. At court they lied in order to get a conviction. I was advised bu my solicitor to plead guilty. No chance, I was totally innocent so I pleaded not guilty and was promptly banned for two years and fined £600.

thats disgusting..... the bloke should be strung up, like people say, how many people have to die first???
if a drink driver hit my son, for example, he wouldn't drive again, after i'd finished drilling his legs with my SDS, i'd use a diamond slab cutter to engrave his knee caps, and chop his ears off and put them in his mouth.....- if he was lucky...
