Legal help on getting owed money
#1
Hi all,
Someone on this board owes me money, £50, he has owed it to me for months and I've been more than patient, the original deal was to send the money return of post when he received my HKS AFR.
Below is the last responce to my email asking for the money again.
Sorry, i have been away on OPS!!! I am sending you first thing in the morning £50 cash by registered mail as i have no time to hang to see if another cheque arrives about due to going to IRAQ.
Now I don't know if this is true or not but even so I haven't had the money.
I sent him an email saying that I would persue my money via small claims court but no answer!
I know he's not in IRAQ as he's posting in drivetrain about the downpipe he fitted Unlees he's fitted it to a tank.
Is this the way to get my money?, are emails permissable as evidence?
It's not just a mix up as there have been many emails sent and replied with things like the above and then I see posts on this board from him.

For that amount your legal recourse is limited.
Could go down the small claims court route, and yes, emails would be admissible as evidence of your claim and his agreement to pay.
But, lot of time and effort for £50.
Personally, I'd pay the person a visit and ask for payment there and then.

I have a sneaking suspicion I know who this is.
However, I'd try a letter to the address, and then follow that up with A Small Claims summons. It's a fixed price these days I believe, and you add the fee to the claim anyway.
Although it's not always worth it in the long run, there is a certain amount of satisfaction to be had in giving someone a CCJ for their credit record, and you might get your money. If it is his folks address, I'm sure they wouldn't let it get that far.
As for popping round, I'd never advocate that, even if he was in the UK. IMHO you're entering a potential minefield doing that.

Why josh?
The guy has said he'll pay, there is no dispute.
I'm not suggesting a heavy handed attitude by any means - simply a polite visit.
Ligitimate collection agents have much more success ringing doorbells that writing letters. The very fact someone is on your doorstep, being polite, usually focuses the mind.
No one can take issue if you behave in a reasonable and professional manner

Hi James, where does this person live? One of us might be near to him and could collect the money for you. Just a thought...if it's within 10 miles of me (Chester) I'd help out.
