Consumer issue,....returned goods...

Bought a DECT phone today,but when i got it home i noticed the contents were just "stuffed" into the box,the instruction book was all creased and the batteries were just loose in the box.Nothing was wrapped or sealed.
It still works fine,and there's nowt wrong with it,but it seems to me its obviously a previously returned item.
Because it works fine,i'll probably keep it,but are shops allowed to just put returned items straight back on the shelf.Whats the ruling on this.
For all i know it could have a fault which i havent discovered yet?....

I currently work at a telecomms company. A phone that has been sold, used in any way and returned cannot be resold as new. If the phone has not been used i.e. connected, it can be classed as new and sold as new.
If a phone is sold, used and returned it will be used by the comms company as a replacement phone for faulty or stolen insurance claims.
