Nearly bought a write off

A mate of mine put a deposit down on a private sale of a Fiat Coupe Turbo and has since found out it was writen off last year according to HPI.
Anyway, the guy who he has paid the deposit never told him it was a repaired write off, and has gone on holiday. He has his home, mobile and work numbers, so can contact him to get the deposit back hopefully.
Where does he stand legally ?? Can hereport the guy for selling a dodgy car ???

Although private, he does have a right to refund, as the goods are not as described.
Might be tricky to prove etc, but you can go to court to get back the deposit, small claims, not too difficult.

to be fair you should ask... However unless the car is 1 owner from new then he might not even know... besides fiat coupe turbo is a waste of money... think of the depreciation..
