Penalty for 68 in a 40 ?

Question

A mate of mine has just opened his post to see that he has been clocked doing 68 in a 40 limit !

What's the damage likely to be ?

I thought it'd just be a 60 sheet tax and 3 points but others reckon he could be looking at 6 points and 450

Yup id say 6 points as its over 50% of the speed limit, the fine may well depend on the court though, a bit silly if you ask me if you get caught doing 68 in a 40 zone as 90% of points/fines are in low speed areas.

best I keep quiet about what I got caught doing in a 30 then. ie town centre.
It wasn't big and it wasn't clever

Cheers Tony,

My mate is talking about arguing the point in court as he reckons that the only reason he was doing 68 was that he'd accelerated out from behind a line of vehicles that had slammed on the anchors when they spotted the mobile gatso ahead! I'm unsure if that is a wise move as it relies on the Mag agreeing that PC Plod was creating a danger by his presence on that stretch of road.

Could end up with a stretch of his own

Court appearence for sure.

Im still waiting to hear back from the plod for my 58 in a 30mph.

Not much point in trying to contest it, if your caught your caught and the courts take a dim view of it.

Best of luck of too your mate but id agree with Tony (must be a first your mate will, as i will be looking at six points!

long time ago mind, when H plate cars came out, the old dear bought a Nissan 200sx and let me take it for a play.
Did I ever get a bollocking for that when the court summons came through the door.
lets just say it was over 75 and leave it there.
oh I only got 14 day ban tho which was a result
thanfully they dropped the dangerous driving charge.
still....cost me over 700 quid in solicitors fees.
worth every penny

A friend of mine got clocked by a fixed Gatso (he knew it was there as well) doing 60mph in a 30.

He got a 58 day ban and £250 fine plus court costs.

No points were added to his license though.

Geri Halliwell was in the oucrt next door for exactly the same offence and got a 58 day ban and a similar fine.

Both admitted guilt.

When I had to go to court for speeding 114mph on a motorway, I pleased guilty and had a letter stating I could loose my job if I lost my license.

I eneded up with a 28 day ban, £250 fine plus costs and no points.

The best advice is just to put you hands up to the offence if you committed it, there is not much you can argue against a photo.

I know a magistrate and she says that they (three lay magistrates generally sit in the County Courts, unless you get a stype magistrates (low ranking judge, that travel around the County Courts)) take a dimmer view of people arguing against the photographic evidence.

I hope it works out okay for him.

6 points is almost guaranteed, plus a fine of at least £10 per 1mph over the limit, plus costs. Its not a ban as your mate was less than 30 mph over the speed limit, but I'm sure the hefty fine and 6 years worth of points will be ample persuasion to slow down.
