Anyone had an insurance payout refused due to a de-cat?

Just wondering. I've declared the full decat but was told that if the car is checked following an accident and is found to fail an emissions test, the insurance company may not pay out. Any one fallen foul of this?

Steve,
Sounds like a load of McCollocks to me... why on earth would a repairer decide to test your emissions after a repair ??!? Providing a car has valid insurance and a valid MOT (if its old enough) it is deemed to be roadworthy...and that's all they should be really bothered about... tax and emissions etc... shouldn't really effect insurance. A major repair involving engine work may result in an emissions check before the garage released the vehicle, but it shouldn't really be an issue..
Basically, if an insurer finds that they are insuring a car that is of a different spec to what it has been notified to them, they are within their rights to decline to pay out - if they see fit.
Best be safe and declare everything you do... mind you some insurers really do take the p1ss with charging extra premium for mods because they simply do not know what they are and what they do...
have fun..

Every MOD has been declared and the extra premium paid. Yet the guy on the phone said that if it fails an emissions test following an incident, the insurance would be in-valid.

Surley you could just tell them:
It passed an emmissions test before the accident.
Here's the MOT to prove it.
It has now failed the emmissions test.
So it must be due to the accident.
Give me my money.
