Checking oil levels

Checking oil levels
Should oil levels be checked when it's hot/cold or in-between?
Only asking as car (MY99) has just been serviced somewhere new and am wondering if they've overfilled it slightly as it seems to be hesitating between 2000-3000rpm more than it usually does.
