It seems that a certain someone has posted on ESC section today more than the members, makes for an entertaining day though trying to post on a thread before it gets locked or nuked.

Very different;
Both parties were in comminication and sorted out an amicable solution; level mature communication was present between both without the need of 'others' to rally round across the whole forum and hound the other party with immature posts. You guys wrecked the project shafted thread resulting in alot of moderated posts, and depsite requests from Paul (NS04) you carried on. Hence it was locked. The fact you carry on like this means I doubt we'll ever be able reopen it. Unless Immy and/or Ross PM us anything new.
Whereas we have Ross, nor Immy willing to reach a solution. In addition, Ross has gone quiet (moved on? or making legal progress - hence the silence?). Meaning that with no communication, no conclusion will be forthcoming.

I have never met the guy, don't know him, never knew of him before all of this. Don't think any of the other mods have heard of him either.
But on the case of who you know, you all know of Ross? Yes? Well I don't, so I'm treating him exactly like Immy. We've had to base our decisions on what we know, and sadly nothing is fully conclusive from the storys provided from either side. As such I will remain on this fence until further notice.

Ross is out finally enjoying his car after spending another 6k having it rebuilt. Stand in Ross's shoes for a second here.
He drives to *** after having email and phone calls about this spec C. In all conversations it's an immaculate well cared for car. they do a deal Pxng his old WRX. 6 months later it dies in a cloud of smoke. Now forgetting all the tuner issues which are irrelevant apart from **** upon inspection it shows signs of a bodged rebuild. The pics are in the project thread. The dealer then let's slip HE had the rebuild done and failed to inform Ross knowing he would likely run a mile. Then further down the line when tuner 1 had family issues and didn't provide the details required *** say that's a different engine to what was in the car originally. TBH Ross isn't even sure what the correct engine number should be so how can anyone confirm is/isn't? Anyway in fear of more infractions I best leve it there.

I feel for Ross as I got caught out in the very same way by another tuning company. I started a project thread because i thought it would be informative to others as to how to cure a minor problem. The further down the line we got with the strip down, the more slap dash build qualities we came across. I decided to end the project thread as it was turning into a witch hunt against the tuner and I felt the end result would be similar to the one we have here. Having said that, I now feel that maybe the guys out there spending their hard earned money should be made aware of the people in the business who are just in it for a quick buck regardless of the consequences. What hurts for the common man is when the people doing the butt f*****g come on here ***** waving at what super car they should buy next.
The mods attitude of sort it out in court, not in here is not fair.
When you have spent your budget on the car of your dreams, then spent another *** grand fixing it. There isn't a lot left to spend on legal fee's.

What warranty was given or implied?
Did the buyer have the car inspected?
If so by whom?
Did the buyer ask if the engine had been rebuilt?
Was the engine mapped for use in the UK?
Was it used on a race track?
If so, did it have its service regime and oil grade altered to cope with the above extreme operating conditions.
Was the seller not given the opertunity to look at the car and rectify the fault from the outset?
Why did the first garage not strip/diagnose/quote/repair the engine?
Is this garage still operating?
Why did it take so long for it to get to the second garage?
Upon being taken to the second garage, was complete or in a basket case when the second garage recieved it (i.e already in bits)?
Why wasn't the new engine not built like for like?
What diffenece in price is this from a standard engine?
What was the cause of the second engine failure?
Has this been rectified?
Would this fault be noticeable to the driver before it manifested in total failure?
How would the seller be expected to notice it BEFORE failure (symptoms) ?
And if diagnosable prior to total failure, what precaution should a seller take to check for this?
Are there any other items on the car other than the engine that are of in need of attention?
Were these outlined by the seller?
Further questions:
Is the seller private or trade?
Who imported the car?
Has the car been used in the UK prior to the sale
If so, by whom and for how long.
What fuel/ignition map did the engine have prior to sale?
When was the first engine rebuilt?
Did the builder give a warranty?
If not, why not?
Why was it rebuilt?
Was the cause of failure properly diagnosed?
If so, what was the cause?
What components were replaced?
Were they replaced like for like?
And were they new or used parts?
What checks were performed prior to sale?
And what was found from these checks?
With the exception to the engine, what other work was carried out to the car?
Final questions:
Which user have direct involvment with this car?
And what involvement is that?
