Looking for some legal advice please.
Hoping someone on here can give me some advice on a certain matter
my youngest boy had a nasty accident in halfauds while buying his brother a bmx. he stuck his index finger into the chain and pedal cog taking resulting in taking his top part of it clean off (first knockle).
it was his own fault i aggree that. but there was no asigned first aid employee in the building at the time of the accident. so i shouted for the ambelance whist telling bods to pick the finger up and get some ice.
now i had to go back in there today as they wanted a report done. i requested the manger and just got an employee. i first ask if there was a first aider on site at the time.. she said no. but they had already checked out the legal side themselves and they do not need a first aider on site at any given time. just as long as they have a first aider appointed within the company??? is this right. for them to check this out themselves. they must have knew i was going to ask the question.
So is that right. no need for a first aider on site all the time whislt the store is open.
it has stated on the acident report that someone placed a bandage on the finger and held it up. but i cannot remember this nor can i deny it as i was in a bit of shock myself trying to comfort him and comfort his brother.

go get your free 30mins with a lawyer. i'm pretty sure you have to have a first aider on site, not one per company. sounds like there trying to fob you off.
should the H and S executive have been notified? retail does fall under the regs as far as im aware so in theory there should be an accident report, was this done?
my info is based on construciton not on retail so you def need to find more info, maybe goive the HSE a call for advice.

Thats the best bit of news. The manager should have made an appearance, just good grace to do so. I cant see that just having a First Aider in the company somewhere is ample protection at all. Like any other organisation, I would hope there would be a first aider on site at all times. Am I asking too much?

Ive just briefly mentioned this to my Mrs. She is a senior surveyor for Cushman & Wakefield. She works in the Retail Asset Manangement team who primary look after shopping centres. She reckons that its only shops in shopping centre's that don't need a first aider onsite within opening hours. Stand alone shops and shops in retail parks do need one all the time
She is going to look into the official gumf as she's not sure of the detailed ruling off the top of her head so i'll get back to you
