Default Not happy

Hi,

Just to let you guys know that someone who was meant to be working with me has gone it alone and is using my trading name. Please don't think that Horizondetailing.com is me. It's not. I am in the process of finding out what's going on. Mine is .co.uk. Hopefully i'll have all this sorted soon.

They have signed up with suppliers under my name and now going it alone. Any help / advise would be much appreciated

It may be a case that all the good work that i've done so far will go to waste and that i have to build up with a new name but i hope not.

I know this isn't the sort of post that is welcomed on here but i don't want people getting confused with the sort out customer service that i have been building with a kid who is only 16 (factual btw).

Cheers,

Matt.

Sorry to read this Matt.

If you want me to go round and pay him a visit, let me know.

Seriously, though, as far as I am concerned, I would only go through you anyway, and anyone would be a fool to let a snotty nosed kid loose on their car with the kind of products and equipment that you use.

cheers guys. just hoping to get this sorted out as soon as possible. the main concern for me is he has signed an agreement with a supplier. i have contacted them explaining the situation and have asked that i get a copy of their reseller agreement (understand it won't be the one he signed) so i can see the terms of the contract.

will keep you all posted. was all going so well too.

matt, dont worry mate...

i would chjange the company name and send a letter to all the suppliers explaining what has happened to you....

its only a few business cards at the end of the day and that way, YOU can do what you want....

i'm sure it will all work out...

name and shame them.....

I'm not being funny but how is he going to get all the gear you need to do the job on his skateboard?

He must be of his head!

Find him and tell him you'll tell his mum!

Could we not bomard his site with false jobs from random addresses so he gets so P1ssed off he jacks it in......... I know its a bit petty but so is stealling someones buisness!!

cheers for the encouragement guys. if it comes to it i will change my name. however it's the principal of the matter as well as the hassle. there are forums that i sponsor on different sites so they would all have to be changed and no doubt at cost to me.

fingers crossed a friendly chat will sort it out.

Just point out to them that as a child he does not have capacity to enter into a contract and anything he's signed is invalid

Under Regulation 874/2004, Article 22(1)(a), an ADR procedure may be initiated by any party where the registration is speculative or abusive within the meaning of Article 21.

Article 21 of Regulation 874/2004 states that a registered domain name shall be subject to revocation using an appropriate extra-judicial or judicial procedure, where that name is identical or confusingly similar to a name in respect of which a right is recognised or established by National and/or Community Law and where it has been registered by its holder without rights or legitimate interest in the name; or has been registered or has been used in bad faith.
