Heatshield on Downpipe

Default Heatshield on Downpipe

I put back a car(my00 turbo) to standard over the weekend and when replacing the original downpipe the only heatshield I have to put on is the remains of the top heatshield when using the decat downpipe. From looking at the brackets on the original downpipe I am assuming that there is another heatshield on the lower part of the original downpipe (close to where the drive is). The thing is that I cannot find this heatshield in the garage.
Would I get away without it? My only concern was that the downpipe is fairly close the the rubber on the drive.

yeah there is a lower one, but easily breaks when removing.

It will be fine without it.
