Xbox burning disks

Hi all,
over the past week I have been having problems with my xbox it has been freezing. I left it over the new year while I was away.
I finished a rubbish long day at work yesterday and thought I would give it another go, got half way through a game of team death match on Black ops and the bloody thing froze again. At this point the disk made a strange noise then I knocking it.
I took the disk out and the brand new black ops disk has a nice perfect scratch across the disk.
I have spoke with Microsoft and they are willing to repair the xbox despite be having it for 2 and a half years (apparently I have the halo 3 version with the extended warrenty - Thankfully) however whenever i bring up the scratch on the disk they shoot me straight down saying the xbox cannot do this and it was due to the system being moved (even though i did not tell them it had been moved slightly - and i do mean slightly).
I am thankful they are willing to have a look at the system however is there anything i can do about the disk? I have not had it long and I am GUTTED

my brothers suffered this i beleve its common the slightest movement and they scratch the disk
i think its gamestation who can repair the scratched cd on some machine they have there

Regarding the disc, if you can borrow a disc of black ops from a friend, simply install it to the hard drive, then all you need to do is put the scratched disc in to play, the disc game data is read from the hard drive and not the disk when copied to the hard drive.
