Default Virgin Scumbags Grrrrrrrrrrr Help Please

Some of you will know that I was flooded out of my property back in May and have had to move to another place permenantly as the old place was so badly damaged it will be up to a year before its habitable again.

In the melee that ensued I've been paying for my Virgin phone/tv/BB package and completely forgot to cancel it. I receive a call from Customer Serv trying to flog me something and I expalined I was delighted they called as I need to cancel my services. Where I've moved to does not have cable so no chance of continuing the service. This woman then tells me I have to pay the rest of my contract regardless

Even after I explained the situation errr no you still pay or we sue you

Am I best off just fighting this as I cannot recieve the service?

were you a VM customer prior to them losing Sky1?

Can you not get the insurance to pay it? it is due to the flooding.

Think I'd try the insurance route as well. Not surprising they want you to pay. After all, you did sign a contract and want to break it early...

They'll have a clause in the contract for Force Majeure - So why can't the customer invoke it.

* lightning;
* flood or severe weather conditions;
* fire or explosion;
* civil disorder;
* damage or vandalism to our network or equipment
* terrorist activities;
* war;
* actions of local or national governments or other authorities; or
* industrial disputes.

Thanks for the replies guys.
* It never occurred to me to use the the insurance route.
* Also I never signed any contract. They sent me one but never got round to signing it.
* Unless Virgin lost Sky in January or later then no.
Seems a bit ironic they can enforce that clause for themselves but not the other way round.
Annoyingly the service was always iffy. My remote never worked half the time or it would freeze and have to be restarted etc. But the internet was always fine.
Going to ring them today, will post up later with the outcome

Looks like I'm off to court as Im not paying for something I have no chance of receiving. They didnt even want to discuss what has happened or how this could be resolved. Pay up or else

Think you'll find that any company will treat you the same in cases like this. Basically you are breaking the contract, not them. It's not their fault that you can't receive the service, and it states in the terms & conditions that this isn't covered, so I'm not sure what legal leg you have to stand on. Might be worth trying the cab first (before spending money fighting a hopeless case)...

What has that got to do with anything? I think I remember reading in the T&Cs that they reserve the right to change the channel line-up (or something like that). Not sure what that has to do with being flooded...

Call up and speak to customer relations .... if need be speak to a manager. Tell them how disappointed you are and how much you thought of Virgin before this happened. If that fails ... PM me.

oh .. just so you know, the customer relations guys have the power to allow a customer to leave a contract early.

Thanks Pimmo, I had Virgin at a previous property and when I moved to a different area there was never any issue of closing the account early but this welsh girl just didnt even want to listen.

I'll make the call and let you know how I get on.
