IR35 - Anyone been caught out ?

Has anyone been caught out by IR35 at all here or know of someone who has ?

Seems to be more a "luck of the draw" (or unlucky!) type of scenario rather than the IR investigating everyone's accounts.

Luck of the draw is correct. I know of a Software house that has an excellent contract which allows susbstitution etc, some cons have been certified OK and other refused (!) with the same contract. I know that some of the failed people have challenged and had it overturned, but not certain if 100% of them have been succesful.
Talking to quite a few cons (it's my job!) and seems 50% are caught and having to stump up the cash, and others are just winging it, hoping they do not get investigated too soon or too well. Seems daft as they can go back 7 years, hmmmm 7x£10,000, I think there will be a few people caught out over the next few years. Have a copy of an excellent IR35 friendly contract if you want it?

Chris is right, but some of the guys chancing it will get caught. I know of people who have had their contracts reviewed and been told they are inside but not of anyoen who has actually been made to stump up any cash yet.

The only safe way is to operate as a proper business and negotiate your contract terms carefully as well.

I'm using a standard IR35 "friendly" one but lost a good one passed to me a while back from another contractor.

I've just signed up with a management company that means you can avoid IR35 and still claim expenses. They take a 6% cut of your earnings but as long as you have a fair amount of expenses (petrol, hotels etc) you get that back in saved tax and more!!! (How much do you pay your accountant??)

I'm not an easy person to please, but this co. really has got things wrapped up water tight.

P.S. I've been a contractor since 1989, so no newbie to tax avoidance
