Default The laws the police have on estimating your speed

I got pulled by the police (traffic)last night
They are taking me to court for apparently dangerous driving and exceeding the speed limit 60mph.
They said i was going between 90/100mph but they have no proof of this as it was a guesstimate.I was overtaking at the time but i was not speeding.They also said that the next time i am brought to there attention for a traffic offence i will loose my scoob and it will be crushed How true is this?
So were do i stand on this matter as i do not whant to loose my licence on a policemans guess

The problem is not the speed, it sounds like they will do you for dangerous driving according to what you say.

Well the last time i heard it wasnt illegal to overtake slow mooving traffic when safe to do so.I also think that as my scoob is rally stickerd up and full de-catted it can look and sound as it's going faster than it is.

then they could get you for having an illegal de-catted car can't they?

that's the problem when you have a car that stands out so much- anything you do gets spotted, if you were in a silver golf tdi they may not have noticed you doing exactly the same manouver at the same speed

Sounds to me like the copper's just found out his wife is getting screwed by the local villain, and is taking it out on you.
They can't crush your car for coming to the attention of plod. The guy's an @rse. He might just be trying to scare you. Sounds like it's worked.

I can see your point there.Might just add that the car went through it's mot on monday and the zorst passed all test.But i must admitt it is loud

Yep thats true. You have now been officially warned (as required by the law). Its a new power brought in under the Criminal Justice Act 2002 IIRC. Not used very often, I cant recall a single case of it actually being implemented, and I suspect there will be a legal challenge when it is, but it IS in law.

Correct s59 of the act. If car is used in a manner likely to cause alarm harassment or distress you can be given a warning. Continuing with that course of conduct can result in the car being seized

Depends on how they estimated the speed, although it does sound like they are considering other offences other than the speed.
As for crushing the car, it is being used and it is on the rise. Under Sec59 of the Police Reform Act (nice guess on the CJA fella) if you use a car in a way likely to harrass or alarm, such as wheel spinning, handbrake turning or even loud music at night, revving engine in built up area at night etc etc you can be warned. You would normally get sent a notice in the post (not sure if this is a legal requirement, provided you have been verbally warned) and a marker is placed on PNC. If the vehicle (not you, the vehicle) is stopped and warned again and they find the Sec59 marker they can have it towed. By the way a Sec 3 or 34 RTA offence can also lead to this(due care and prohibition of off road) Section being implemented.
Scoobynetters as well as general boy racers really need to know about this, it's really starting to kick in.

So what did they actually say to you ?

Were you given a notice of intended prosecution? (NIP)

Did they say that they were reporting you for prosecution for a) speeding and/or b) dangerous driving?

What documentation were YOU given?

How were you stopped? Were they in a vehicle or standing?

And did they ask you for your documents or give you a producer?

They also did me for my number plate they had to get a tape messure out. I will not be fighting this one though

Thanks guys, still aint heard anything but i wish id of known about them sites beforehand, will be putting a copy of my rights in the car for the next time

yes officer i want to read my rights before you continue and i will sit there as long as i like
