That's all well and good if buying private. Bit when buying from a garage/forecourt you generally pay a premium over a private sale as the garage is by law required to give you more protection. So your sentences above hold no weight in afraid unless strictly a trade sale with no commupance or receipt given.

Unless mentioned on any sales receipt re. the issues but I've not heard of this before.

Correct, I was messaging off phone ealier so was trying to minimize typing.

My point very much stands the same. It is not straight forward to ask for a refund. Under section 14.9 of the sale of goods act the OP is within his rights to ask for a refund under the circumstances as not being as advertised. I'm assuming that the vehicle was advertised as having no faults. By discussing the matter of the eml light and then still purchasing the vehicle and driving away. The OP has accepted there could be a potential problem. What other reason would that light be on for? Pleading ignorance or saying that the dealer assured him that the car was fine may help with the case.

If the dealer chooses not to pay the refund due to mutual acknowledgement of the fault then what do you do? go to court? How much will that cost and how long will it take? Other option is to ask the dealer to rectify the problem at their cost. Then you have to trust that the repair work will be carried out to a suitable level of repair.

There is more options than this but instead of mulling over on a car forum, take the vehicle back and go from there.

The car is with them ATM they are fixing it but can't do anything until Tuesday morning since its a bank holiday weekend. The garage said they will try replacing the coil pack to sort the misfire on 1&4 that's all I know until Tuesday

Let them do all the work at their expense. If you are not mechanically minded get a third party to inspect and check fault codes after the work is complete.

There is I guy close to me who I've been advised to take it to. Duncan @ hypertech in bonnybridge
I will take the car to him after mvm have "fixed" it. And maybe get him to write a report or something on it?

There waiting on hydronic lifters or something coming in from Subaru. Should have the car back by the weekend. He is going to check the oil usage as well

I would be worried about the fact the engine was knackered originally due to a shortage of oil and yet there was no work done to the pistons etc when it was rebuilt. Perhaps it was burning some oil then and still is now?

isnt the fact they have taken it back for repair something very important. i would not accept it back until everything and i mean everything has been fully checked and working properly !

Well I was meant to get the car back today and the garage called. after they replaced the coil pack and the hydrolic lifters, they took it for a test drive. The car is still burning oil and fouling the plug in cylinder 4 causing the misfire. So it's engine out, then off to get fixed. He's going to make it priority and hopefully get the car back to me by next weekend. I'm just glad I dont need to pay for this because it sounds expensive! He thinks it's either the piston or the rings.

Andy F is £450 for the first map I believe as you need to get the ecutek license.

as the engine is out and obviously going to need a rebuild, are you sure you want it back as its being rebuilt yet again so the last one was obviously not great and the garage in question obviously dont know what they are on about as proved earlier in the thread.
i would get a refund and find a good car if i was you.

I'll say it again - and I bet you most will agree with me! There's probably only 5 or 6 places in the country that I would trust to touch a Scoob engine. If I found a car that had been rebuilt by anyone else, I would simply run for the hills !

Coil packs don't drink oil

Ask the dealer if you could nominate an engine builder, find out the cost from his builder and your nominated one. If his is cheaper then have yours do the work and pay the difference.
At least that way you know you have a solid build that will last you many many years.

You are well within your rights to choose who does the work.

Well mvm have rebuilt the car, got it running and there's a water leak! He said its coming from one of the manifolds and it's fresh antifreeze. So still no car and still no further forward! The original problem was one of the pistons

I've asked them 3 times to check what turbo is on it and they've never gave me an answer. I'm going to the garage tomorrow afternoon so I will check myself when I'm there

sounds like a great engine repair and its going to be a reliable car, should get 50 to 60 miles out of it before it pops

Have u phoned them and told them its been for a re build and it's still ****ed . Tell them your not happy with it . Will speak to a mate of mine there will be a way to can get out of it if it's still ant right !!!!!!!!!

sale of goods act- goods must be fit for useage.

obviously not, how long since you purchaced the car? how many days have you had it? and the garage?

i had a problem with mine last car after 4 months, told them i'd stand on the pavement with a big sandwich board on warning potential customers about the faults. they sorted it within a week, new turbo and other bits too. get some ***** with them, as long as things are true, theres nothing they can do (about the sandwich board)

to go to the small claims court, i think it's only £25


other option, take it on a track day ASAP (but don't tell them) and see if it lasts

but, i'd be trying to get a refund
