That's not quite the point. As a "modern financial" organisation, they have to jump through certain regulatory hoops and adhere to codes of conduct and regulations. As per Alg's post. If they can't prove it was properly sold, then it's likely that a claim would succeed. (IMO and I'm an armchair layabout, not a legal eagle...).

Indeed

They actually produced a form where I ticked the box for PPI

The Financial Ombudsman still awarded in my favour

The claims consultant is also confident of a third claim I have made even though I had made a succefull claim against the policy!!!!
