i'll email VOSA later as well - mine's been fixed by a genuine Subaru dealer at a cost of over £300, would definately try and claim that back if possible! I got it fixed because it got so bad in the cold spell, i could actually hear the escape of pressurised fuel from the leaky pipe when the fuel pump was primed a few times in a row - i would definately class that as a safety issue.

I also contacted VOSA today about this - they gave me a call back and had a brief chat about it.
Looks like they're waiting to get hold of a couple of cars to have them looked at by Subaru (would have thought this should be an independent instead of Subaru?). Other than that, we'll have to wait and see.
But obviously, if anyone who has this problem who hasn't notified VOSA, get on to them about it I get the feeling it will go quiet as there will be insufficient evidence of a problem in the warmer weather, but then it'll all kick off again next winter.

Ok quick update guys, Vosa is sorting out a date soon to collect both my car and one other (i have told them they can have mine any time they like), apparently a chap is flying out from Japan to oversee the whole thing.. so sounds like we are making some progress with this.
I will keep you all informed as i know more.

Just noticed this, thought i left my fuel cap off one day, then noticed it more and more over the winter cold spell, as i could smell petrol on cold mornings. Thought i was going mad!
Hopefully Subaru own up to it, as i read that dealers do have a modification to fix this................. if WE pay for it.
BMW bottle it the moment safety issues are raised concerning anything to do with fuel systems!!
Subaru should follow suit.

Thanks mate.
Right i have sent this......
To whom it may concern,
I am the owner of the above mentioned vehicle. I and have found over the recent cold spell of this year, the car increasingly smells very strongly of fuel from the engine bay whilst the engine is runing.
At the point of the smell being detected, I immediately pulled the car over and turned off the engine.
Upon lifting the bonnet, I managed to vaguely locate the smell to be comming from below the engine's intake manifold. There are no split hoses I could see.
I am a qualified motor mechanic and have come to the conclusion that this is a design fault/manufacturing fault.
This fault however, seems to stop upon the ambient temperature raising above the point of freezing.
I am concerned that this fault could result in fuel vapour igniting, causing a fire risk. Not to mention the overpowering smell of fuel that enters the cabin when it occurs.
I have researched this issue online and have found on many subaru owners forums (specifically www.scoobynet.com of which im a member) that this fault doesn't seem to be isolated to just my vehicle.
I would like to request that VOSA investigate this issue, as a possible safety related recall that Subaru should undertake to remedy as soon as possible.
Kind regards,
Mr Matthew Spina.

Been discussing this with my regional technical manager.
His oppinion is that if the fault causes fires, they would weigh up the cost of possible occuring law suit pay outs, against the cost of recalling all vehicles.
Then they would make the decission of The cheapest option being taken.

Right, the chap rung me this morning. He seemed to side on the fact that Subaru are not entertaining the fault as a safety recall. This is due to there not being enough fuel vapour to cause an ignition on a hot surface (i.e the engine)
He has sent me a fault form online which i'll fill out tonight.
However he did assure me that he will keep chasing it up with Subaru.
Seems like they aren't having it.
My question is, why did Subaru recall in the states but not over here? Hotter climates maybe??

The issue as such is not one that is related to fire as this only occurred on mine when the outside temperature is less than 3 degrees, and should go away when the engine and the heat warm up the inlet which expands and seals the metal clips which have not been done to a safe amount to stop fuel vapour escaping during cold conditions.
The worst case scenario and what happened to me was leaving for a journey and then joining a motorway which had no slip lane as the M3 was being repaired so I either had to stop and risk having someone drive into the back of me or open all windows and wait for the engine to warm up, the VSOA need to focus on the presence of a high quantity fuel vapour that could impede the drivers ability and be a cause of an accident.
I spoke to the local dealer SGT and they said it was related to the clips not being done up to the correct specification they said to remove the inlet and check all pipes for damage and wear and then check the clips. My mechanic did this and said the clips were not holding the pipes on and you could pull the pipes off as clips were not tight enough hold the fuel pipes in place. They were tighten and have been fine during some very cold weather since.
