Avoid e-bay is what it implies to me - unless you have time and the legal inclination to work out what being a UK seller mean. Ridiculous - this portal is getting a SERIOUSLY dodgy rep as they dont give a hoot who they do business with, as long as the $$$ dollar is green.
Dont back up the foreign rip off merchants in the face of home grown guys ehh?

I have a return address of Hong Kong and the grammar used in the e-mails I have received is poor.
He's asking we split the costs of the customs as it's not "his responsibility"
As it's now 10 days since purchasing the kit I'm raising a dispute with EBay - if you can't trust their supposed Power Sellers who can you trust?

Is his email address a UK one ( i.e. btinternet or something similar ? ) - it could well be he is in the UK but is getting them drop shipped directly from Hong Kong.
Not strictly against Ebay rules, but drop shipping is a bit dodgy as far as keeping your customers happy goes.
If he isnt based at all in the UK you're going to struggle as different laws apply for overseas purchases, unlike the DSR which apply to UK sales ( but only if the company IS based in the UK ) which do a lot more to protect buyers.

I bought the item through Paypal and have just raised a dispute with them.
If anyone is interested I'll keep you appraised of developments. Not quite a Pete vs Currys but hopefully I'll get as good an outcome.

Paypal probably wont refund until you have returned the item to the seller, and have trackable proof that it has been returned.
If it was a UK seller, this is straightforward enough as the DSR allow you to return goods for any reason you like, and the seller must reimburse you for any return postage costs. If the seller is based overseas though, you dont have any rights to return this way, so it will be down to the seller to accept the return, and they arent obliged to pay for the return p&p.
One problem you will have is that paypal claims are generally for goods not received or not as advertised - as the seller seems to have sent you what you bought ( and having the box opened when you received it will be hard to prove as the seller can just say you opened it, which you would have to do to get the item out ) your claim is just for the import duty you had to pay.
One bit of good news though is that if you do send it back, and can prove that you did you can reclaim the import duty you were charged - you can get in touch with HMRC and get a form from them where you can tell them the goods were returned and they will sort out a refund.
Main thing is to try and find out if the seller actually is in the UK, or if they are overseas as this will make a big difference. I think the best offer was just turned down though. (Split the cost)

As mentioned, to someone who knows ebay auctions, the style screams imported item. Something like that I would only buy if the pic is of the item and they aren't one of these "dropship" sellers.

I know that the item would be an import as it cannot be bought in the UK. However, the advert clearly states the location is in the UK, so the logicial conclusion is that it has already been imported and the costs covered.
It also states that the cost of delivery is £20 (approx). Given that I was required to pay a further £25 on top of that means the goods are not as advertised.
I do not think it is unreasonable of me to expect the goods delivered according to the cost advertised.

Question now is: do I leave positive feedback? I'm concerned if I neg him he'll only reciprocate.
I'll set the dispute as closed as I'm happy with that outcome - now to ponder EBay.

Positive feedback because he has come through for you.
On the top of the pages where you type in what you to search for, to the right of the search button there is an "advanced search" link as well.
If you click on that it will take you to another page where you can do other searches.
Once you are on that page, on the list on the left it will say "members" and underneath a link for "Find Contact Information".
If you fill in the item number and their User ID, Ebay then sends you their supposed contact information.
If they have said on their member information that they are in the UK there, it would be somewhat suspect that you are being charged import duty! as they have already told Ebay that they are a UK seller

Thanks for the rapid replies folks - I've left a positive feedback, and stated that a customs mix up was amicably sorted with excellent communication.

you did well to get any money back, but i would hazzard a guess that your subtle clue wont help anybody, as much bigger clues are on the listing to start with
