You're quite correct, thats what the Tech Guys said too ..... they said it is a replacement TV if the pixel is in the right place - it's about 10mm outside 'their' area.

LG have said to me that that 'area' no longer applies and CURRYS have the old policy - I have told them and all they keep saying is 'Manufacturers Spec'

It's a brickwall - I have had 3 different CURRYS Support people write to me, 4 Engineers turn up and mumble, they have not treated me as a Customer ... I am really staggered by their attitude.

Just found out that I can withold the amount that the TV cost from my Credit Card Company and it is illegal for them to charge me interest on the witheld amount!

I can withold it until the situation is resolved - I can imagine them witholding the amount from the CURRYS account in response ....... could be my fastest way to satisfaction?

Of course, CURRYS and the Credit Card Company will 'come on strong' to me .....

Surely this was bought months ago? You will have paid the Credit Card Company by now, as I am sure you do not pay interest if you can avoid it? How will you get round that?

Along the same lines the Credit Card Company will have paid Currys months ago?

Doesn't really have the impact if all monies have already been paid does it?

What this has done for me is make me avoid Currys at all costs. Not easy round here as they have the market cornered.

Well, as I understand it, I can withold the 'amount' in dispute - whether I cleared that part of the debt or not.

I think ....

As the CC Company are jointly liable, I simply say I'm not paying them £800 of my next bill .... I guess?

No, thats not how it was for me when I last put in claim. I wrote in a letter explaining what had happened. From the details I offered, the credit card company determined to claim back/withhold monies until the dispute was settled. I didn't get the actual choice to tell the credit card company to withhold the monies.

Andrew, thanks for your comment ..... what I meant was that I would withold monies from the CC Company, not me telling them what to do with regards CURRYS (that's their issue) - all I am interested in is getting my £799:99 back and getting whoever to pick the TV up and leave me alone.

This is a Template letter from the BBC Watchdog Website:-

Dear ___________

I am writing to notify you about why, and on what basis I am withholding £____ from the amount owing on my account.

On {date} I entered into a contract with ________ for the ________ of ________ The contract price was £____ And I paid using my ________ Card (see enclosed copy page from my ________ card account).

{Explain why matter has not been resolved by the supplier (eg not acknowledging complaint or gone out of business)}.

Do you think the BBC WatchDog program would be interested in following this to Court and beyond? I've sent an e-mail to them, they would have my full co-operation in any program ............... I dare say that will get someone at CURRYS to call me politely and ask how I could be assisted

I wrote to watchdog, I did get a nice letter back from them saying that they hope I get my problems sorted out (Telewest flooded my house the day I moved in, and left pipes leaking water out whilst they all went home)

Watchdog also said that they couldnt help me something about it being an isolated case, or not enough interest to persue it etc etc

Take them to court and get it over and done with, if you win,well done, if you lose either sell it or live with it. The longer you leave making a decision, the harder it'll be if you lose.

I read something by Donald Trump once and he said "whatever you do, do something. If its wrong then correct it, but at least do something".

I have been in Court quite a few times and the one single thing I have learned is that the Judge looks kindly on those who have tried to settle .... thats why CURRYS are 'offering to take the TV into the workshops' it's their defence.

The problem they have is that they state it is operating with an acceptable fault (so, why take it anywhere?) - what wil they do in the workshops, they haven't told me yet - what is the Spec. that they based their secision upon, they cannot supply it.

Nah, all I need is that the judge looks at it and says that it is unsatisfactory quality ...... sorted. BUT, he also needs a very good reason why I refused to allow them to take it into the workshops (without getting technical).

The Credit Card Company has written to me today to say they are investigating and will be in contact soon ..... things take time to exhaust avenues.

Pete, if you knew what you know now and were about to buy an LCD or Plsma tv how would you go about buying it. Would you ask for the exact spec regarding pixels, would you buy it from a different place, or by a different method.

paulr - I would do a few things different, and everyone could learn from my problem.

1. I would NOT buy from CURRYS/DIXONS/PCWorld - I thought they were big enough to treat their customers well. I was wrong.

2. I would check the TV pixel by pixel when I got it home and turned it on - return within 28 days and you are safe.

3. I would buy from somewhere like John Lewis - and somewhere offering a 5 Year Warranty free.

4. I would ask what the PIXEL Policy is of the make I was about to buy - some manufacturers now will not ask their customers to accept anything less than a 100% perfect panel ..... LG are dragging their heels on this I think.

5. I would still buy the TV that showed the best picture consistently in the shop.

But point number 1 is paramount!

If this thread has stopped only one person buying from the CURRYS/DIXONS/PCWorld Group then it will have served some useful purpose - aside from letting me rant and glean independant responses!

I have 3 letters from them:-

Letter 1:- TV has a purity error - we cannot help you

Letter 2:- The Engineers report number 1 states working within spec. - report number 2 states offered uplift to workshops (not to repair), you refused

Letter 3:- We will not comply with your request for a refund or replacement

All from Sheffield, all from different people, all from CURRYS Support.

Simon69 are you affiliated in some way with the Dixons/PC Turd etc group ?

Pete, your thread has made me think twice about a number of things, one is the level of support, second is I would rarely buy anything from Dixons etc and your thread has added another reason

And also it has made me think about tolerances, bad pixels etc, it is something I have been aware of since the days of LCD began (even back with the old black & white laptops) and I have always accepted the tolerance levels for blown pixels

My undertsanding in the past is that quite a number of pixels can be blown (in fact I had a number of them 6 I think IIRC on my old LCD Projector) and still be classed as acceptable *unless* they were all next to each other or in very close proximity to each other, so that it would detract from your viewing pleasure

Obviously the larger the screen/image one pixel can be quite large, and very off putting

Sonic - LG give the diameter as 30mm ... if there are two dead pixels within that then it is a new panel. LG have said that it doesn't matter where they appear on the screen.

My point is that the pixel is not dead - it is live, it is bright green, it is flashing and it is so annoying ....... I find myself staring at it whatever is on the TV at the time!

I'm really not sure how the Sale of Goods Act sits alongside faults which CURRYS consider as acceptable?

Their Engineers all said that they could not live with it - and that is the test for a 'reasonable person' ... I assume they would not employ an unreasonable person?

One question I would like answered is this:- If CURRYS really thought I had no claim and the TV had no fault and it was operating within spec. ...... why offer to take it into the workshops??? I can only assume that if I allow it to leave my home I remove my right to a full refund?

They employ sharp practises, they attempt to restrict your rights, they are sharks!

I have thought about that .......... and it would be a possibility - but, ask yourself something, if you bought your Scooby and it wouldn't go over 3000 RPM thus ruining your fun - would you change the RPM numbers so that it 'appeared' like you were able to rev to 7000 RPM?

And thats why I don't think I should accept expensive faulty goods. And for CURRYS to try and bully me into accepting them is a disgrace which needs to be tackled.

Just got a standard letter from the Credit Card Company ....... basically admiting that they are jointly liable in law - but, saying that I must pursue CURRYS through the Courts first. Not quite sure if thats true.

Anyway, rang them up - apparently, if you put the amount into 'dispute' they will knock that amount off your balance until the claim is settled ...... effectively giving you your money back, for a while at least!

I'm sure CURRYS will sit up and listen more to the CC Company than poor likkle me

Need to do some more research on how far I need to take the dispute before claiming off the Credit Card Company ................... ??
