Any chance you could say where Motorpoint is going wrong ?

Motorpoint bought my Impreza from Liaco Malta - Motorpoint registered it -Motorpoint sold it to me (but not before telling me I wouldn't be the first recorded keeper) - so I got a secondhand car with 5 miles on the clock - Liaco gave me a 3 yr / 60,000 mile European warranty with cross border acceptance - and then I hear that Subaru UK distribution network is trying to wriggle out of its obligations which it has with Fuji Heavy Industries Japan to participate along with all other distributors in Europe (not just EC) in a European warranty with cross border acceptance !

Maybe we should write to FHI Japan for an explanation !!

Motorpoint and other indepentents are not authorised distributers of subarus in the UK and as such the cars sold as new by them will not have thier warranties upheld by IM.
It is a technacality in trademark law,but if they can stop them why not do it.??? business is business

anyone heard back from motorpoint? i phoned them wednesday & thursday. apparently the director was away until friday and would call me...guess what- he didn't!

there's meant to be a test case going through soon to see if the warranty gets approved. this has been pi$$ing me off for 6 weeks now grrr

Probably mine.......!!! Subaru Cyprus contacted me last week and asked me to supply all documentation directly to them, they told me they were going to Japan with the info!

I'm just totally frustrated now.... NO ONE will tell me whats going on, IM don't reply to calls, I haven't had anything in writing to tell me I have or haven't got a warranty and have an on-going suspension problem that needs fixing but NO ONE will authorise repair!!!!

I have been incredibly patient up to now but I am rapidly reaching the end and am now getting totally p****d off with all concerned. If I don't hear anything in the next 7 days I'm going to take legal advice..... (luckily I work in an industry where a lot of my friends and collegues are briefs so no shortage of eager help!!!)

I had the same suspension problem and Motorpoint paid for the work to be done direct via a credit card payment.

My 'dealer' has already paid for the banging NS rear shock and mount to be replaced but the offside is sticking now which would appear to be linked to the original problem. My 'dealer' doesn't seem eager to pay for any more work!

Just an thought

What would happen if all the people who where told there car had 3 year warranty ( sorry to the people who where told it was in dispute and still went ahead with the purchase, your got no legal right to the warranty you were informed before purchase) anyway back to the idea, if we all return the cars on mass on the same day to motorpoint ect. as being mis-sold. who would return them to malta ect. what would the dealer or more important FHI do then. We are legally in the right to demand the contacts being cancelled.

I wonder if that would kick start things again.

PS. about 2 weeks ago subaru malta telephoned me to get copies of all paperwork , invoices ect that I had. But they have not contacted me since.

I haven't had a response from either side yet either confirming that i have a warranty or not i have contacted Subaru Malta but still haven't had a response. I contacted the office of fair trading which i had a response today to say that they cannot help as they do not take on individual cases. So far i have contacted:

What Car
Car Magazine
SMMT
Trading Standards
Watchdog
Top Gear
Scooby Magazine

I have also seeked further legal advice today. I feel the more of us that complain then we will back one side into a corner into saying something instead of this blocked silence that we are currently experiencing now. Like they say there is strength in numbers and its a lot harder to ignore a lot of us than it is just a few individual cases.

After reading someone's thread about Motorpoint selling new shape WRX's for £16999, i have just phoned them up out of interest to see what they say to a "new customer" and surprise surprise they are offering a 3 year manufacturer's warranty as they are sourced from Malta!

What is going on?!

Either they are not taking a blind bit of notice of all the people having warranty issues now or Subaru Uk are in the wrong and it is perfectly legal for them to continue to sell these cars with the full 3 year warranty.

Just a point, I notice on this thread that only motorpoint are mentioned. what about the other dealers, e.g. allbrandnew, Virgin, Alliance car imports & litchfield.

Alliance state the the purchaser will be listed on the log book as the first owner, does this make any difference, surely this would then be classed as a personal import and the warranty would then be valid?

In theory that should be correct. IM may ask for a lot of paperwork to prove this though.

At first they said it came with a one year warranty but she would check then she came back and said these new ones have come from Malta and come with a 3 years manufacturers warranty.

Sounds about right to me. But when I looked into idea of bringing a car in (not from Malta - they weren't in EU back then) I found out I would have to complete the tax forms myself. Presumably with a genuine personal import you would have to do this, not the likes of motorpoint etc. so that paperwork would also be very relevant in proving it wasn't supplied by an unauthorised supplier.

It is irrelevant whose name is on the log book 1st or whose name is in the warranty book.

Under the selective distribution model adopted by FHI/IM the only way a car can be imported and retain all the manufacturers benefits 'cross border' (i.e. warranty) under EU laws and regulations is for the end user to have signed a mandate requesting that the intermediary/importer/broker source him a vehicle elsewhere in the EU. The request doesn't have to be very specific (i.e. it can say please source me a silver car) but it does have to be dated on or prior to the date the intermediary/importer/broker orders the car from the dealer in Cyprus, Malta or wherever.

Unfortunately this is not how a lot of the import dealers work in the UK. They buy the cars in in bulk and then sell them on to the end user. This is in breach of EU rules and regs and unfortunately IM would appear to be within thier rights not to administer the warranty.

Everything rests on that signed and dated mandate!

Interesting thread to read - I've just bought an 18 month old STi Type UK rather than get a brand new WRX import (this discussion cemented my thoughts).

Anyway, just to add what I've heard - it's Mitsubishi who've started all this EU malarky off in relation to the amount of pick-ups/twin cabs coming in throughh this route. Subaru have just picked up on what Mitsi are saying/doing with the amount of pan-european warranties being registered.

Seems like there is a loop hole they're exploiting down to fine detail as mentioned above.

I can understand those who already bought Euro imports being dischuffed but it's a bit off if these organisations are not fully explaining the situation to new customer enquiries.

Can also see why IM are unwilling to administer pan european warranty claims, but for me it's FHI and the UK government who need to get their house in order and get european pricing levelled and warranties being truely pan european.

Hope it all gets sorted soon.

I have just been on the phone to Motorpoint as I was dead set on buying a MY05 WRX from them or Alliance.
They stated that there would be NO manufacturers warranty at all. They would give me a 1 year warranty of their own which they said would cover exactly the same as the Subaru one. I could extend it for a further year for £299 or for a further 2 years for £499.
Incidentally they are also advertising MY05 WRX "Xtreme" models so I asked what these were as I'd not heard of them before - Motorpoint are claiming these put out 295bhp, have flared wheel arches and soft compound tyres.
Anybody know any more about this model? BHP figure sounds a bit high.

Anyway - I was ready to buy - now I am completely confused and have no idea what to do.

Depends how long you're prepared to wait for enough signatures to build up to warrant (excuse the pun!) a bulk order being placed.

Bought my car from Motorpoint 3 weeks ago. Haven't had the warranty book back yet, so I haven't tried to register with Subaru UK, but i'm pretty sure i'll be in the same boat as Donny, Vipa, & Gubby. (The one without a paddle.)

Can anyone clarify my situation? There has been alot of discussion on this subject and I now cant see the wood for the trees.

I purchased my WRX import from Alliance in April. I registered it with IM and had a letter back from them confirming that I was enter onto there system for cross country warranty purposes.

Is my warranty null and void now?
