Just finished the errrr statement/book for the day just over 5000 words/8 pages of articulated fluff I reckon I'm about half way through Don't know why I'm bothering though, suppose it's the principal of the matter more than anything, anyway time for a drink

tim after this u may need a week or 2 in AA m8
i bet u need somthing strong to take your mind off things though
btw if i was in your shoes i'd be locked up and the 2 tw@ts would be on a ward somewhere on a ventilater an lots of tubes coming out of them

So how are the 3rd party Co. coping with your system? Do you know if your employers still need your knowledge? (but it looks as if they've decided to cut off their nose)

Afternoon people, here is the the update from my meeting...

Ok turned up nice & smart ...

Was quite straight forward, my 9 page statement was very clear & concise & raised alot of 'interesting' points.

So after 2 hours and some fresh information, the chap has decided he will need to take untill Tuesday to chew on it before making any decision.

Went far better than I anticipated tbh, probably helps as the 3rd 3rd party company bought in has still not managed to sort anything things out almost 3 weeks later.

Ummmn oh well thanks everyone for all the support so far, I'll keep you all posted

They will probably give you your job back on the understanding that you are on shaky ground/final warning. At least get the job back, secure the system, and then look for jobs while getting a full time wage. Note that warning should only stay on you record for 6 months then it should be destroyed from all records, assuming you have been a good boy for 6 months.

I hope all goes really well over the next few weeks, and I am sure everyone here does too.

Whatever happens you know you're going into a new job as I'd certainly wouldn't want to work in a place that did that to me! Talk to your lawyer after the outcome to see what you can sue for (making you a nervous wreck, unable to go out alone....etc ) and then sell your story to the tabloids so that your company gets dragged through the gutter!

Yep decison to be made on Tuesday Next Week - 4th May!

Not sure what to do if they offer me my job back, the thought has'nt really crossed my mind tbh, but after today it may well be on the cards...

What a strange month I'm having

Got a few jobs/people to see over the next couple of days fingers crossed could do with getting back to work soon really had enough time off

I've not read this thread before - apologies as it is an interesting one to say the least!

I recently sued for Constructive Dismissal and although it never went to tribunal, received a very large pay-off 3 days before it did. If you do go or decide that your position is untenable, then I'd be very happy to give you the name of my solicitor who was absolutely excellent and a recommendation from another scoobynetter.


Reading all this, I'm a bit concerned about your long-term future at this company. You indicated that a fellow member of staff dibbed you and as you've shown, its taken them 3 weeks to get to this stage. What position is this other member of staff? Is s/he more senior? It sounds a bit as though they have it in for you and the management have gone along with it. Why?

Now you have gone back to them & basically thrown straight back all the points they have made with a reasoned and backed up argument. Yet, they're still undecided and want to take nearly another week before they come to a decision. They are also still in a pickle regarding their IT stuff and its costing them ££. There's no face saving stuff here, you're either in or out. My take on it is that they thought they could get rid of you under the Gross Misconduct line but now are having to consider the steps they have taken.

I would almost say that it it is tantamount to constructive dismissal. You have the legal right to have faith in your managers to look after your interests, yet it is clear here that they are not. They have a duty of care to do so which it can be seen they are not doing.

I would also check EXACTLY what are the terms of how you come back IF you come back. Some person or persons will be unhappy that their attempt to have you ousted/disciplined has gone titsup. They won't be happy and will not be making your life easy if you do go back - hence question as to seniority of person. Your position may be totally untenable in the future. If they "allow" you back under final written warning type thing, then I would suggest that once you'd got the system back up & running, had new proceedures in place "in case you got run over by a bus" that you'd find that you'd be made redundant or otherwise got rid of.

The only way (IMHO) that you can go back is with a clean slate and preferably with the snout getting a carpeting for their behaviour. Anything else & its constructive dismissal time.



Regarding the "theft" of company passwords. When I left, I cleared my desk of all I wanted (personal stuff) and cleared the computers of all PERSONAL documents etc leaving behind all company related stuff. I also purged my Outlook of all emails sent/received. Some months later I got phoned by the police in that the MD had reported me for theft of a domain name and destruction of valuable company data! The domain name I had registered and he had refused to pay me for, so nothing they could do on that and the data destruction was personal files and as there was no "proceedure" regarding that, again nothing they could do. The police thought it was quite amusing.

Bottom line with theft, the law in this country specifies that theft is the intention to permanently deprive, so they'd have a hard time trying to prove that in court, but it does show that your company does not hold you in high enough regard in that they'd even think you guilty of theft. Again a reason to think that your position is untenable.

I'm sorry that this has come about, their behaviour has been shocking. There's politics being played here and prehaps you would be better off out of it.

Still cannot believe they are holding off on a decision.

As said get back in there and continue looking for another job, it is easier to find work when you are already in work as you are more relaxed at the interview.. if I get it then great, if I don't then I have a job anyway.

Sounds to me as if they've realised that they've made a BIG mistake. I guess they will spend the long weekend working out how to give you your job back - you know my thoughts on that! Nice post by Puff BTW.

Does sound like they expected you to either say "yep stole passwords and .... etc" and them sack you and you evidence obvious stopped them in their tracks.. have to go away and think about it as told his boss he was sacking you etc..

total miss management of the situation..

Your employer has, in my humble opinion, behaved deplorably.

You must know that you have no future with that organisation.
Nor should you want too.
Nor do they deserve you.

Take all legal advice possible - including CAB info - They were very helpful for me last year.


If you go down the unfair dismissal route then I believe the cap on payment is £7500
whereas constructive dismissal can net up to £50,000

Will have to wait and see what they come up with next, don't really want to go back, but need an income, so my plan will probably goback for a short time & make proper efforts to get something better.

Weird how they continue to leave it in limbo, like people have said as far as I'm concerned I'm either in or out..

Meant to be getting paid tonight (weds night/thurs morning), hoping.....

The employee who made the intial complaint is a security guard..

I report directly to the MD but I don't think he understands what I do, or how it will affect the business my been absent/sacked

LMFAO then surely the security guard should have been doing his job & stopping these little ***** from interfering with your car, I'd report him for not doing his job properly

Been following this thread & TBH I'm fkin shocked at the way your company have acted, the papers would have a field day with this - I'd take it to the media if I were you lol

You have to show interest in keeping your job, helps with the tribunal...
